  1.1                          A bill for an act 
  1.2             relating to education; altering implementation of the 
  1.3             profile of learning; requiring a report on graduation 
  1.4             standards; amending Minnesota Statutes 1998, section 
  1.5             120B.03, subdivision 1, and by adding subdivisions; 
  1.6             repealing Minnesota Rules, part 3501.0370, subpart 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 120B.03, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [DISTRICT IMPLEMENTATION OF THE PROFILE OF 
  1.11  LEARNING.] (a) A school district shall implement the profile of 
  1.12  learning of the graduation rule under paragraph (b), (c), or (d).
  1.13     A district may implement the profile of learning under 
  1.14  paragraph (c) or (d) only after the commissioner approves the 
  1.15  district's request for a waiver and approves the local plan for 
  1.16  full implementation. 
  1.17     (b) A school district shall implement the profile of 
  1.18  learning for the 1998-1999 school year and later.  
  1.19     (c) A school district shall implement the profile of 
  1.20  learning as follows: 
  1.21     (1) for the 1998-1999 school year and later, the district 
  1.22  shall implement all required standards in learning areas at the 
  1.23  preparatory level and implement for ninth grade students a 
  1.24  minimum of six learning areas under the profile of learning with 
  1.25  three from the areas of read, listen, and view; write and speak; 
  1.26  mathematical applications; scientific applications; and people 
  2.1   and cultures; and three from the areas of literature and the 
  2.2   arts; inquiry; decision making; resource management; and world 
  2.3   language; 
  2.4      (2) for the 1999-2000 school year and later, the district 
  2.5   shall implement for ninth and tenth grade students two learning 
  2.6   areas in addition to those implemented under clause (1).  The 
  2.7   district shall complete the four learning areas of read, listen, 
  2.8   and view; write and speak; mathematical applications; scientific 
  2.9   applications; and people and cultures if the four areas were not 
  2.10  completed in clause (1); and the remainder from the areas of 
  2.11  literature and the arts; inquiry; decision making; resource 
  2.12  management; and world language; and 
  2.13     (3) for the 2000-2001 school year and later, the district 
  2.14  shall implement for ninth, tenth, and eleventh grade students 
  2.15  the two learning areas in the profile of learning that were not 
  2.16  implemented under clauses (1) and (2). 
  2.17     (d) A district shall develop a local plan to implement the 
  2.18  profile of learning and have all ten learning areas fully 
  2.19  implemented by the 2001-2002 school year.  
  2.20     (e) A district shall notify the commissioner by July 1, 
  2.21  1998, as to whether the district will implement the profile of 
  2.22  learning under paragraph (b), (c), or (d). 
  2.23     (f) An advisory committee of 11 members is established to 
  2.24  advise the governor and commissioner on the implementation of 
  2.25  the graduation rule under this section.  The commissioner shall 
  2.26  appoint 11 members with representatives from education 
  2.27  organizations, business, higher education, parents, and 
  2.28  organizations representing communities of color. 
  2.29     The committee shall review the implementation of the basic 
  2.30  requirements and the profile of learning standards. 
  2.31     The commissioner shall provide technical and other 
  2.32  assistance to the advisory committee.  The committee expires on 
  2.33  December 1, 1998.  Notwithstanding any other law to the contrary 
  2.34  and the other provisions of this subdivision, students shall not 
  2.35  be required to meet the profile of learning requirements for 
  2.36  graduation until such time as the commissioner of children, 
  3.1   families, and learning reports to the legislature that: 
  3.2      (1) the department has completed modifications recommended 
  3.3   by a state-funded, independent, expert analysis of the standards.
  3.4   Modifications must clearly address implementation of the 
  3.5   graduation standards for all students, and in particular, 
  3.6   students with unique needs; for example, but not limited to, 
  3.7   students enrolled in the following programs:  special education, 
  3.8   limited English proficiency, advanced placement/international 
  3.9   baccalaureate, post-secondary enrollment options, area learning 
  3.10  centers, and transfer students; and 
  3.11     (2) sufficient computers, software, training, and other 
  3.12  support are in place for recordkeeping and to ensure consistent 
  3.13  communication between schools and school districts. 
  3.14     Sec. 2.  Minnesota Statutes 1998, section 120B.03, is 
  3.15  amended by adding a subdivision to read: 
  3.16     Subd. 1a.  [REPORT TO LEGISLATURE.] The commissioner shall 
  3.17  provide a report to the education committees of the legislature 
  3.18  by November 15 of each year regarding progress toward meeting 
  3.19  the requirements of subdivision 1, paragraph (f).  The initial 
  3.20  report must include an analysis of any final reports on the 
  3.21  external examination of Minnesota graduation standards and 
  3.22  related procedures, policies, and assessments, and the 
  3.23  department of children, families, and learning plan for 
  3.24  implementation. 
  3.25     Sec. 3.  Minnesota Statutes 1998, section 120B.03, is 
  3.26  amended by adding a subdivision to read: 
  3.27     Subd. 1b.  [EXPIRATION.] If the requirements of subdivision 
  3.28  1, paragraph (f), clauses (1) and (2), have been met as 
  3.29  evidenced by the report required by subdivision 1a, then 
  3.30  subdivision 1, paragraph (f), and subdivision 1a shall expire. 
  3.31     Sec. 4.  [REPEALER.] 
  3.32     Minnesota Rules, part 3501.0370, subpart 4, is repealed. 
  3.33     Sec. 5.  [EFFECTIVE DATE.] 
  3.34     Sections 1 to 4 are effective the day following final 
  3.35  enactment.
