A bill for an act
relating to the legislature; proposing an amendment to the Minnesota
Constitution, article IV, section 4; providing staggered terms of office for
senators and staggered four-year terms of office for representatives; reducing
the size of the legislature; amending Minnesota Statutes 2004, sections 2.021;
2.031, subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

ARTICLE 1

LEGISLATIVE TERMS OF OFFICE

Section 1. new text begin CONSTITUTIONAL AMENDMENT.

new text begin An amendment to the Minnesota Constitution, article IV, section 4, is proposed to
the people. If the amendment is adopted, the section will read:

Sec. 4.

Representatives deleted text begin shall be chosen for a term of two years, except to fill a vacancy.
deleted text end new text begin and new text end senators shall be chosen for a term of four years, except to fill a vacancy and except
new text begin as otherwise required by this section. new text end There shall be an entire new election of all the

legislative apportionment provided for in this article. new text begin At that election, senators elected
from odd-numbered districts, half the representatives from odd-number districts chosen
in a manner provided by law, and half the representatives from even-numbered districts

call elections to fill vacancies in either house of the legislature.

new text begin The proposed amendment must be submitted to the people at the 2006 general
election. The question submitted must be:

new text begin "Shall the Minnesota Constitution be amended to require that representatives be
elected to four-year terms and that, as nearly as practical, one-half the senators and
one-half the representatives be elected at each general election beginning in 2012?

ARTICLE 2

SIZE OF LEGISLATURE

Section 1.

Minnesota Statutes 2004, section 2.021, is amended to read:


2.021 NUMBER OF MEMBERS.

members and the house of representatives is composed of 118 members.

members and the house of representatives is composed of 110 members.

Sec. 2.

Minnesota Statutes 2004, section 2.031, subdivision 1, is amended to read:


Subdivision 1.

Legislative districts.

The representatives in the senate and house of
representatives are apportioned throughout the state in deleted text begin 67 senate districts and 134 house

entitled to elect one senator and each house district is entitled to elect one representative.
