A resolution
memorializing the President of the United States to respect and comply with the rulings
of the Judicial Branch in recognition of the Judicial Branch as a separate and co-equal
branch of government, as contemplated by the United States Constitution.
WHEREAS, the United States is the world's oldest democracy and the only country that has
enjoyed continuous democracy for over 200 years; and
WHEREAS, to safeguard this democracy, the Founding Fathers established a Republic with
three co-equal branches of government, building a system of checks and balances that are articulated
in the United States Constitution; and
WHEREAS, the ability of any democracy to survive and flourish relies on a strong respect
for the Rule of Law, a concept that is enshrined numerous times in the nation's Founding Documents:
the Declaration of Independence, the Constitution, and the Bill of Rights; and
WHEREAS, President Trump has challenged the authority of the courts and questioned their
rulings in a succession of recent cases, criticizing judges that rule against him and calling for their
removal; and
WHEREAS, in an extraordinary display of the escalating conflict between the Executive and
Judicial Branches, Chief Justice John Roberts rejected calls for impeaching judges shortly after
President Trump demanded such removal, stating "For more than two centuries, it has been
established that impeachment is not an appropriate response to disagreement concerning a judicial
decision"; and
WHEREAS, in spite of a 6 to 3 conservative majority, the United States Supreme Court has
ruled unanimously against the Trump administration and ordered it to facilitate the release of Kilmar
Ábrego García, who was mistakenly deported to a mega-jail in El Salvador, in compliance with a
District Court's Order; and
WHEREAS, thus far the Trump administration, in defiance of the Supreme Court's decision
and rejection of its authority, continues to ignore the Ábrego García Order, arguing that the District
Court does not have the power to issue such an order and sought an Appeals Court to block the
lower court's ruling; and
WHEREAS, the Appeals Court, in an opinion written by conservative judge and Ronald
Reagan appointee Harvie Wilkinson III, issued a scathing rebuke of the Trump administration,
calling its defiance in this case "shocking" and imploring the Trump Administration to respect the
Rule of Law, warning that it is "all too possible to see in this case an incipient crisis"; NOW,
THEREFORE,
BE IT RESOLVED by the Legislature of the State of Minnesota that it urges the President
of the United States to respect and comply with the rulings of the Judicial Branch in recognition
of the Judicial Branch's authority as a separate and co-equal branch of government under Article
III of the United States Constitution.
BE IT FURTHER RESOLVED that the Secretary of State of the State of Minnesota is directed
to prepare copies of this memorial and transmit them to the President of the United States, the
President and the Secretary of the United States Senate, the Speaker and the Clerk of the United
States House of Representatives, and Minnesota's Senators and Representatives in Congress.
