A bill for an act
relating to higher education; providing that the legislature shall elect members to
Board of Regents when a vacancy exists during a regular legislative session;
amending Minnesota Statutes 2020, section 137.0246, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 137.0246, is amended by adding a subdivision
to read:

new text begin Elections must be held. new text end

new text begin The legislature shall hold a joint convention to elect
members to the Board of Regents pursuant to the Minnesota Constitution, article XIII,
section 3, and Territorial Laws 1851, chapter 3, section 5, in any regular legislative session
during which:

new text begin (1) a vacancy exists on the board;
new text end

new text begin (2) a vacancy will exist within that calendar year due to a board member's term expiration
or announced resignation or retirement; or

new text begin (3) an appointee of the governor has filled a vacancy pursuant to the Minnesota
Constitution, article XIII, section 3, and Territorial Laws 1851, chapter 3, section 6.
