A bill for an act
relating to natural resources; modifying goals to be considered when reviewing
public waters work permits for structures in public waters; amending Minnesota
Statutes 2018, section 103G.245, by adding a subdivision; repealing Minnesota
Rules, part 6115.0210, subpart 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 103G.245, is amended by adding a subdivision
to read:

new text begin It is the goal of this section to carefully review
the occupation of public waters by offshore navigational facilities, retaining walls, and other
structures in order to:

new text begin (1) preserve the natural character of public waters and their shorelands;

new text begin (2) provide a balance between protecting public waters and using and enjoying public
waters both from on the water and from onshore; and
new text end

new text begin (3) encourage removing existing structures that do not serve the public interest from the
beds of public waters at the earliest practicable date.

6115.0210 STRUCTURES IN PUBLIC WATERS.

Subpart 1.

Goals.

It is the goal of the department to limit the occupation of public waters by offshore navigational facilities, retaining walls, and other structures in order to:

A.

preserve the natural character of public waters and their shorelands;

B.

provide a balance between the protection and utilization of public waters; and

C.

encourage the removal of existing structures which do not serve the public interest from the beds of public waters at the earliest practicable date.
