  1.1                          A bill for an act 
  1.2             relating to telecommunications; requiring notice to 
  1.3             neighboring landowners when tower or mounting 
  1.4             structure erected; amending Minnesota Statutes 1998, 
  1.5             section 237.45. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 237.45, is 
  1.8   amended to read: 
  1.9      237.45 [TELEPHONE AND TELEGRAPH LINES CONSTRUCTED.] 
  1.10     (a) Natural persons, copartnerships, and associations may 
  1.11  construct, maintain, and operate telephone and telegraph lines, 
  1.12  and shall have and possess the same rights, powers, and 
  1.13  privileges with reference thereto as corporations formed for 
  1.14  such purpose.  
  1.15     (b) A telephone or other telecommunications company shall 
  1.16  notify each landowner within one mile of a site where the 
  1.17  company proposes to erect or construct a tower or mounting 
  1.18  structure for its equipment.  Notice must be given at least 30 
  1.19  days before the company obtains a permit to erect or construct 
  1.20  the structure.
