  1.2             relating to crime; requiring individuals on 
  1.3             conditional release to carry a conditional release 
  1.4             verification card; imposing criminal penalties; 
  1.5             proposing coding for new law in Minnesota Statutes, 
  1.6             chapter 609. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [609.134] [CONDITIONAL RELEASE VERIFICATION 
  1.9   CARD.] 
  1.10     Subdivision 1.  [TERMS.] (a) For purposes of this section, 
  1.11  the following terms have the meanings given. 
  1.12     (b) "Conditional release" has the meaning given in section 
  1.13  401.01, subdivision 2. 
  1.14     (c) "Conditional release verification card" or "card" means 
  1.15  a card issued to a person on conditional release by a probation 
  1.16  officer that states the terms and conditions of an individual's 
  1.17  conditional release. 
  1.18     (d) "Peace officer" has the meaning given in section 
  1.19  626.84, subdivision 1. 
  1.20     (e) "Possession" means on the person's body or clothing.  
  1.21  Possession also means: 
  1.22     (1) within the person's residence when the person is in the 
  1.23  residence; or 
  1.24     (2) within the person's work environment when the person is 
  1.25  in the work environment, provided it is not practicable for the 
  1.26  person to carry the card while at work. 
  2.1      (f) "Probation officer" means a county probation officer 
  2.2   with powers and duties under section 244.19; a state parole and 
  2.3   probation agent with powers and duties under section 243.05; and 
  2.4   a probation officer with powers and duties under section 401.02. 
  2.5      Subd. 2.  [ISSUANCE OF CONDITIONAL RELEASE VERIFICATION 
  2.6   CARD.] On or before August 31, 1998, every probation officer 
  2.7   must issue a conditional release verification card to each 
  2.8   person under the probation officer's supervision who is on 
  2.9   conditional release. 
  2.10     After August 31, 1998, every probation officer must issue a 
  2.11  conditional release verification card to each person under the 
  2.12  probation officer's supervision who is on conditional release.  
  2.13  This card must be issued at the time the probation officer first 
  2.14  meets with the person on conditional release or within seven 
  2.15  days of receiving the person for supervision, provided a card 
  2.16  has not already been issued to the person, whichever comes first.
  2.17     If the conditional release verification card is mailed to a 
  2.18  person on conditional release, the card must be mailed by 
  2.19  certified mail. 
  2.20     Subd. 3.  [REQUIREMENT FOR PERSON ON CONDITIONAL RELEASE; 
  2.21  PENALTY.] Every person on conditional release must have a 
  2.22  conditional release verification card in possession at all 
  2.23  times.  A person on conditional release must produce this card 
  2.24  on demand of a peace officer, a probation officer, or a district 
  2.25  court judge.  If a person on conditional release does not 
  2.26  produce the card upon demand of a peace officer, a probation 
  2.27  officer, or a district court judge, the person on conditional 
  2.28  release is guilty of a gross misdemeanor. 
  2.29     Subd. 4.  [EXEMPTION.] A person on conditional release is 
  2.30  exempt from this requirement until the person receives a 
  2.31  conditional release verification card. 
  2.32     Sec. 2.  [EFFECTIVE DATE.] 
  2.33     Section 1 is effective August 1, 1998, and applies to 
  2.34  offenses committed on or after that date.
