A bill for an act
relating to funeral and memorial services; prohibiting the disruption of a
funeral, memorial service, or a funeral procession; providing criminal penalties;
proposing coding for new law in Minnesota Statutes, chapter 609.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Definitions. new text end

new text begin The following terms have the meanings given them:

new text begin (1) "facility" includes a cemetery in which a funeral or memorial service takes
place; and
new text end

new text begin (2) "funeral or memorial service" includes a wake or a burial, as defined in section
149A.02, but does not include a service that is not intended to honor or commemorate
one or more specific decedents.

new text begin Disorderly conduct prohibited. new text end

new text begin (a) No person may do any of the
following during a funeral or memorial service, during the 60 minutes immediately
preceding the scheduled starting time of a funeral or memorial service if a starting
time has been scheduled, or during the 60 minutes immediately following a funeral or
memorial service:

new text begin (1) engage in conduct that is prohibited under section 609.72, within 1,000 feet of
any home of the deceased's immediate family members, or any entrance to a facility being
used for the service with the intent to disrupt the service; or

new text begin (2) intentionally block access to a facility being used for the service.

new text begin (b) No person, with the intent to disrupt a funeral procession, may impede vehicles
that they know are part of the procession.

new text begin (c) No person may do any of the following during a funeral or memorial service,
during the 60 minutes immediately preceding the scheduled starting time of a funeral
or memorial service if a starting time has been scheduled, or during the 60 minutes
immediately following a funeral or memorial service:

new text begin (1) engage in conduct that is prohibited under section 609.72, within 1,000 feet of
any home of the deceased's immediate family members, or any entrance to a facility being
used for the service; or

new text begin (2) block access to a facility being used for the service.

new text begin (d) No person may impede vehicles that are part of a funeral procession if the
person's conduct violates section 609.72.

new text begin (e) Any person who violates this section is guilty of a gross misdemeanor. Any
person who violates paragraph (a) or (b) after having been convicted of a violation of
this section is guilty of a felony.

new text begin This section is effective the day following final enactment
and applies to crimes committed on or after that date.
