  1.1                          A bill for an act 
  1.2             relating to Garrison-Kathio-West Mille Lacs sanitary 
  1.3             district; imposing requirements on the parties in 
  1.4             order for state funds appropriated to the project to 
  1.5             be made available.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [GARRISON-KATHIO-WEST MILLE LACS SANITARY 
  1.8   DISTRICT PROJECT; STATE FUNDING CONTINGENT.] 
  1.9      State funds appropriated for the Garrison-Kathio-West Mille 
  1.10  Lacs sanitary district project must be made available for the 
  1.11  project only after the Garrison-Kathio-West Mille Lacs sanitary 
  1.12  sewer district has entered into an agreement with ML Wastewater 
  1.13  Management, Inc. and the Mille Lacs Band of Ojibwe, or amended 
  1.14  the Sewer Services Agreement in existence on the effective date 
  1.15  of this act, to provide: 
  1.16     (1) that state law applies to the interpretation of all 
  1.17  agreements, disputes, arbitration, or litigation relating to the 
  1.18  sanitary district and its agreements, or the carrying out of 
  1.19  other efforts of the sanitary district; 
  1.20     (2) that arbitration and litigation of disputes is under 
  1.21  procedures authorized in Minnesota law and that the Minnesota 
  1.22  state court has jurisdiction over any dispute involving the 
  1.23  sanitary district or arising out of the agreement; 
  1.24     (3) the Mille Lacs Band of Ojibwe irrevocably waives 
  1.25  adjudicatory and regulatory jurisdiction over the sanitary 
  2.1   district and all residents of the district who are not members 
  2.2   of the Mille Lacs Band of Ojibwe; and 
  2.3      (4) the Mille Lacs Band of Ojibwe waives sovereign immunity 
  2.4   for all matters related to the agreement and the sanitary 
  2.5   district.
