A bill for an act
relating to motor vehicles; making technical corrections to provisions relating
to park trailers; updating references to certain federal law and regulations;
amending Minnesota Statutes 2008, sections 168.013, subdivision 1; 168A.085,
subdivision 1; repealing Minnesota Statutes 2008, section 168.098.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 168.013, subdivision 1, is amended to read:


Subdivision 1.

Imposition.

Motor vehicles, except as set forth in section 168.012,
using the public streets or highways in the statedeleted text begin , and park trailers taxed under subdivision
1j,
deleted text end shall be taxed in lieu of all other taxes thereon, except wheelage taxes, so-called, which
may be imposed by any city as provided by law, and except gross earnings taxes paid by
companies subject or made subject thereto, and shall be privileged to use the public streets
and highways, on the basis and at the rate for each calendar year as hereinafter provided.

Sec. 2.

Minnesota Statutes 2008, section 168A.085, subdivision 1, is amended to read:


Subdivision 1.

Limitations.

No application for certificate of title or registration may
be issued for a vehicle that was not manufactured in compliance with applicable federal
emission standards in force at the time of manufacture as provided by the Clean Air
Act, United States Code, title 42, sections 7401 through 7642, and regulations adopted
pursuant thereto, andnew text begin with applicable motor vehiclenew text end safety standards as provided by the
National Traffic and Motornew text begin Vehiclenew text end Safety Act, United States Code, title deleted text begin 15deleted text end new text begin 49new text end , sections
deleted text begin 1381deleted text end new text begin 30101new text end through deleted text begin 1431deleted text end new text begin 30170new text end , and regulations adopted pursuant thereto, unless the
applicant furnishes either proof satisfactory to the agent that the vehicle was not brought
into the United States from outside the country or all of the following:

(1) a bond release letter, with all attachments, issued by the United States Department
of Transportationnew text begin pursuant to the Code of Federal Regulations, title 19, section 12.80,
paragraph (e),
new text end acknowledging receipt of a statement of compliance submitted by the
importer of the vehicle deleted text begin anddeleted text end new text begin in which the importer affirmsnew text end that the deleted text begin statementdeleted text end new text begin vehiclenew text end meets
deleted text begin thedeleted text end new text begin all applicablenew text end safety deleted text begin requirements as provided by Code of Federal Regulations, title

Environmental Protection Agency stating that the vehicle has been tested and known to
be in conformity with federal emission requirements; and

(3) a receipt or certificate issued by the United States Department of the Treasury
showing that any gas-guzzler taxes due on the vehicle as provided by deleted text begin Public Law 95-618,
