A bill for an act
relating to liquor; changing license requirements for microdistilleries; amending
Minnesota Statutes 2020, sections 340A.101, subdivision 17a; 340A.22, subdivision
4.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 340A.101, subdivision 17a, is amended to
read:


Subd. 17a.

Microdistillery.

"Microdistillery" is a distillery operated within the state
producing premium, distilled spirits in total quantity not to exceed deleted text begin 40,000deleted text end new text begin 100,000new text end proof
gallons in a calendar year.

Sec. 2.

Minnesota Statutes 2020, section 340A.22, subdivision 4, is amended to read:


Subd. 4.

Off-sale license.

A microdistillery new text begin producing 40,000 proof gallons or less of
distilled spirits in a calendar year
new text end may be issued a license by the local licensing authority
for off-sale of distilled spirits, with the approval of the commissioner. The license may
allow the sale of deleted text begin one 375 milliliter bottledeleted text end new text begin up to three litersnew text end per customer per day of product
manufactured on site, subject to the following requirements:

(1) off-sale hours of sale must conform to hours of sale for retail off-sale licensees in
the licensing municipality; deleted text begin and

(2) no brand may be sold at the microdistillery unless it is also available for distribution
by wholesalersdeleted text begin .deleted text end new text begin ; and

new text begin (3) bottles must be sold at no less than 110 percent of the price wholesalers charge for
sale of the same product to an off-sale licensee.
