1.1 A bill for an act 1.2 relating to crime; requesting the sentencing 1.3 guidelines commission to include as a mitigating 1.4 factor for departure situations where the defendant 1.5 has provided substantial assistance to authorities. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. [REQUEST; SENTENCING GUIDELINES COMMISSION.] 1.8 The sentencing guidelines commission is requested to amend 1.9 section II.D of the Minnesota sentencing guidelines to include a 1.10 mitigating factor for departure in situations when a defendant 1.11 provides substantial assistance to authorities in a case 1.12 involving a drug offense under Minnesota Statutes, chapter 152, 1.13 or a case involving a firearm or weapons offense under Minnesota 1.14 Statutes, section 609.165, 609.66, 609.667, 609.67, 624.713, 1.15 624.7131 to 624.7141, 624.716, or 624.7181. This ground for 1.16 departure shall provide that the court may depart from the 1.17 guidelines upon motion of the state, indicating that the 1.18 defendant has provided substantial assistance in the 1.19 investigation or prosecution of another person who has committed 1.20 a drug offense under Minnesota Statutes, chapter 152, or a case 1.21 involving a firearm or weapons offense under Minnesota Statutes, 1.22 section 609.165, 609.66, 609.667, 609.67, 624.713, 624.7131 to 1.23 624.7141, 624.716, or 624.7181. 1.24 The sentencing guidelines commission is requested to 1.25 establish criteria the court may consider in determining the 2.1 appropriate reduction in sentence. These criteria may include, 2.2 but are not limited to, the following: 2.3 (1) the court's evaluation of the significance and 2.4 usefulness of the defendant's assistance, taking into 2.5 consideration the state's evaluation of the assistance provided; 2.6 (2) the truthfulness, completeness, and reliability of any 2.7 information or testimony provided by the defendant; 2.8 (3) the nature and extent of the defendant's assistance; 2.9 (4) any injury suffered, or any danger or risk of injury to 2.10 the defendant or the defendant's family resulting from the 2.11 assistance; and 2.12 (5) the timeliness of the defendant's assistance. 2.13 Sec. 2. [EFFECTIVE DATE.] 2.14 Section 1 is effective August 1, 1998, and applies to 2.15 offenses committed on or after that date.
