1.1 A bill for an act 1.2 relating to firearms; limiting the number of pistols 1.3 or semiautomatic military-style assault weapons a 1.4 person may acquire within a 30-day period; providing 1.5 an exception for firearms collectors; amending 1.6 Minnesota Statutes 1996, sections 624.7131, 1.7 subdivisions 4 and 6; and 624.7132, subdivisions 5 and 1.8 9. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 Section 1. Minnesota Statutes 1996, section 624.7131, 1.11 subdivision 4, is amended to read: 1.12 Subd. 4. [GROUNDS FOR DISQUALIFICATION.] (a) Except as 1.13 otherwise provided in paragraph (b), a determination by the 1.14 chief of police or sheriff that the applicant is prohibited by 1.15 section 624.713 from possessing a pistol or semiautomatic 1.16 military-style assault weapon shall be the only basis for 1.17 refusal to grant a transferee permit. 1.18 (b) A chief of police or sheriff shall refuse to grant a 1.19 transferee permit to an applicant if the chief or sheriff 1.20 determines that the applicant last acquired either a pistol or a 1.21 semiautomatic military-style assault weapon within the past 30 1.22 days, unless the chief or sheriff determines that the applicant 1.23 is acquiring the pistol or semiautomatic military-style assault 1.24 weapon solely for investment purposes as a firearms collector. 1.25 Sec. 2. Minnesota Statutes 1996, section 624.7131, 1.26 subdivision 6, is amended to read: 1.27 Subd. 6. [PERMITS VALID STATEWIDE.] Transferee permits 2.1 issued pursuant to this section are valid statewide and shall 2.2 expire after one year. The permit authorizes the transferee to 2.3 acquire only one pistol or semiautomatic military-style assault 2.4 weapon in any 30-day period unless the chief of police or 2.5 sheriff has exempted the transferee from this limitation because 2.6 the chief or sheriff determined that the transferee is acquiring 2.7 the pistol or semiautomatic military-style assault weapon for 2.8 investment purposes as a firearms collector. The commissioner 2.9 shall develop a permit form that reflects the date of each 2.10 pistol or semiautomatic military-style assault weapon transfer 2.11 and whether the transferee is exempt from the 30-day purchase 2.12 limitation. A transferee permit may be renewed in the same 2.13 manner and subject to the same provisions by which the original 2.14 permit was obtained, except that all renewed permits must comply 2.15 with the standards adopted by the commissioner of public safety 2.16 under section 624.7151. Permits issued pursuant to this section 2.17 are not transferable. A person who transfers a permit in 2.18 violation of this subdivision is guilty of a misdemeanor. 2.19 Sec. 3. Minnesota Statutes 1996, section 624.7132, 2.20 subdivision 5, is amended to read: 2.21 Subd. 5. [GROUNDS FOR DISQUALIFICATION.] (a) Except as 2.22 otherwise provided in paragraph (b), a determination by the 2.23 chief of police or sheriff that the proposed transferee is 2.24 prohibited by section 624.713 from possessing a pistol or 2.25 semiautomatic military-style assault weapon shall be the sole 2.26 basis for a notification of disqualification under this section. 2.27 (b) A determination by the chief of police or sheriff that 2.28 the proposed transferee last acquired either a pistol or a 2.29 semiautomatic military-style assault weapon within the past 30 2.30 days is a basis for a notification of disqualification under 2.31 this section, unless the chief or sheriff exempts the proposed 2.32 transferee from the 30-day purchase limitation because of a 2.33 determination that the proposed transferee is acquiring the 2.34 pistol or semiautomatic military-style assault weapon solely for 2.35 investment purposes as a firearms collector. 2.36 Sec. 4. Minnesota Statutes 1996, section 624.7132, 3.1 subdivision 9, is amended to read: 3.2 Subd. 9. [NUMBER OF PISTOLS OR SEMIAUTOMATIC 3.3 MILITARY-STYLE ASSAULT WEAPONS.] (a) Except as otherwise 3.4 provided in paragraph (b), any number of pistols or 3.5 semiautomatic military-style assault weapons may be the subject 3.6 of a single transfer agreement and report to the chief of police 3.7 or sheriff.Nothing in this section or section 624.7131 shall3.8be construed to limit or restrict the number of pistols or3.9semiautomatic military-style assault weapons a person may3.10acquire.3.11 (b) A person may not acquire a pistol or a semiautomatic 3.12 military-style assault weapon if the person acquired either a 3.13 pistol or a semiautomatic military-style assault weapon within 3.14 the past 30 days, unless the chief of police or sheriff where 3.15 the person resides exempts the person from the 30-day purchase 3.16 limitation because of a determination that the person is 3.17 acquiring the pistol or semiautomatic military-style assault 3.18 weapon solely for investment purposes as a firearms collector. 3.19 Sec. 5. [EFFECTIVE DATE.] 3.20 Sections 1 to 4 are effective August 1, 1998, and apply to 3.21 crimes committed on or after that date.
