  1.1                          A bill for an act 
  1.2             relating to liquor; authorizing the city of 
  1.3             Minneapolis to adopt an ordinance authorizing on-sale 
  1.4             of intoxicating liquor by hotels during certain hours; 
  1.5             exempting certain sales from on-sale hours 
  1.6             restrictions; amending Minnesota Statutes 1998, 
  1.7             section 340A.504, by adding subdivisions. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 340A.504, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 2a.  [CERTAIN DISPENSING EXEMPT.] Where a hotel 
  1.12  possessing an on-sale intoxicating liquor license places 
  1.13  containers of intoxicating liquor in cabinets in hotel rooms for 
  1.14  the use of guests staying in those hotel rooms, and a charge is 
  1.15  made for withdrawals from those cabinets, the dispensing of 
  1.16  intoxicating liquor from those cabinets does not constitute a 
  1.17  sale for purposes of subdivision 2. 
  1.18     Sec. 2.  Minnesota Statutes 1998, section 340A.504, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 7.  [EXTENDED HOURS FOR ON-SALE.] Notwithstanding 
  1.21  subdivision 2, the city of Minneapolis may enact an ordinance 
  1.22  that authorizes the issuance of on-sale intoxicating liquor 
  1.23  licenses that permit a hotel licensee that operates a restaurant 
  1.24  to make on-sales of intoxicating liquor between the hours of 1 
  1.25  a.m. and 2 a.m. Monday through Friday and between the hours of 1 
  1.26  a.m. and 2:30 a.m. on Saturday and Sunday.  The ordinance may 
  2.1   not limit licenses issued under this subdivision to a particular 
  2.2   geographic area of the city.  The city of Minneapolis may issue 
  2.3   a temporary permit to a hotel licensee that operates a 
  2.4   restaurant authorizing the hotel to sell intoxicating liquor at 
  2.5   on-sale between the hours of 1 a.m. and 2 a.m. Monday through 
  2.6   Friday and 1 a.m. and 2:30 a.m. Saturday and Sunday.  Such a 
  2.7   temporary permit may only be issued for the period of time 
  2.8   between the date of issuance and the date on which the hotel's 
  2.9   license under section 340A.404, subdivision 1, expires.  No more 
  2.10  than one permit under this subdivision may be issued to any 
  2.11  hotel.  A permit under this subdivision may be revoked or 
  2.12  suspended in the same manner as a license under section 340A.415.
  2.13     Sec. 3.  [EFFECTIVE DATE.] 
  2.14     Section 2 is effective upon approval by the Minneapolis 
  2.15  city council and compliance with Minnesota Statutes, section 
  2.16  645.021.
