A bill for an act
relating to port authorities; modifying appointments to the Seaway Port Authority
of Duluth; amending Minnesota Statutes 2016, section 469.050, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 469.050, subdivision 2, is amended to read:


Subd. 2.

Duluth.

The Seaway Port Authority of Duluth consists of seven commissioners:

and two by the governor.new text begin The three appointments by the St. Louis County board must include
one commissioner who represents the Duluth area and two commissioners whose districts
encompass an active mining area.

A member of the St. Louis County delegation of the state house of representatives
appointed by that delegation, and a member of the St. Louis County delegation of the state
senate appointed by that delegation are advisory members of the authority.

Sec. 2. new text begin EFFECTIVE DATE; APPLICATION.

new text begin (a) Section 1 is effective the day following final enactment and applies to vacancies on
the board occurring on or after that date.

new text begin (b) Notwithstanding Minnesota Statutes, section 469.050, subdivision 4, or other
authority, the initial appointments made to reflect the representation required by section 1
shall be made as follows:

new text begin (1) the first vacancy of an appointment made by the Duluth City Council shall be filled
by the St. Louis County board and considered to be one of its three appointments and must
be filled by a commissioner whose district encompasses an active mining area;

new text begin (2) the first vacancy of an appointment by the St. Louis County board after clause (1)
has been satisfied, must be filled by a commissioner whose district encompasses an active
mining area.
