  1.1                          A bill for an act 
  1.2             relating to crimes; making it a felony to assault a 
  1.3             school official and inflict demonstrable bodily harm; 
  1.4             amending Minnesota Statutes 2000, section 609.2231, 
  1.5             subdivision 5. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 609.2231, 
  1.8   subdivision 5, is amended to read: 
  1.9      Subd. 5.  [SCHOOL OFFICIAL.] Whoever assaults a school 
  1.10  official while the official is engaged in the performance of the 
  1.11  official's duties, and inflicts demonstrable bodily harm, is 
  1.12  guilty of a gross misdemeanor.  If the assault inflicts 
  1.13  demonstrable bodily harm, the person is guilty of a felony and 
  1.14  may be sentenced to imprisonment for not more than three years 
  1.15  or to payment of a fine of not more than $6,000, or both.  As 
  1.16  used in this subdivision, "school official" includes teachers, 
  1.17  school administrators, and other employees of a public or 
  1.18  private school. 
  1.19     Sec. 2.  [EFFECTIVE DATE.] 
  1.20     Section 1 is effective August 1, 2002, and applies to 
  1.21  crimes committed on or after that date.
