  1.1                          A bill for an act 
  1.2             relating to telecommunications; modifying voting 
  1.3             requirements for extended area service within combined 
  1.4             school districts; amending Laws 1997, chapter 59, 
  1.5             section 1, subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Laws 1997, chapter 59, section 1, subdivision 
  1.8   3, is amended to read: 
  1.9      Subd. 3.  [CRITERIA.] The commission shall grant a petition 
  1.10  under subdivision 1 when each of the following criteria has been 
  1.11  met:  
  1.12     (1) a majority of ballots of the customers voting in each 
  1.13  of the local telephone exchanges identified in the petition 
  1.14  favor extended area service installation; 
  1.15     (2) at least ten percent of the customers of each local 
  1.16  telephone exchange identified in the petition are also residents 
  1.17  of the combined school district; and 
  1.18     (3) each local telephone exchange identified in the 
  1.19  petition is contiguous to another exchange identified in the 
  1.20  petition.  
  1.21     Sec. 2.  [EFFECTIVE DATE.] 
  1.22     Section 1 is effective retroactively to April 29, 1997.
