A bill for an act
relating to transportation; requiring consultation by Minnesota Department
of Transportation on roundabout design; amending Minnesota Statutes 2008,
section 161.162, subdivision 1, by adding a subdivision; proposing coding for
new law in Minnesota Statutes, chapter 161.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 161.162, subdivision 1, is amended to read:


Subdivision 1.

Applicability.

The terms in sections 161.162 to deleted text begin 161.167deleted text end new text begin 161.1675new text end
have the meanings given them in this section and section 160.02.

Sec. 2.

Minnesota Statutes 2008, section 161.162, is amended by adding a subdivision
to read:

new text begin "Person" means a natural person, partnership, corporation,
association, or other legal entity.

Sec. 3.

new text begin [161.1675] ROUNDABOUTS.

new text begin (a) For any trunk highway construction, reconstruction, or maintenance project in
which a new roundabout is proposed or substantially altered, the commissioner may
complete a final layout only after:

new text begin (1) consideration of the suitability of the roundabout design for commercial motor
vehicles, as defined in section 169.011, subdivision 16;
new text end

new text begin (2) consultation on the design with the Minnesota Trucking Association; and
new text end

new text begin (3) consultation on the design with representatives, as identified by the commissioner,
of persons who regularly obtain oversize or overweight permits under chapter 169 and
travel on a route that would require use of the roundabout.

new text begin (b) Nothing in this section limits or otherwise affects the powers of the commissioner
to determine the design for a trunk highway project.
