  1.1                          A bill for an act 
  1.2             relating to municipalities; providing for a bidding 
  1.3             exception for certain water tank service contracts; 
  1.4             amending Minnesota Statutes 2000, section 471.345, by 
  1.5             adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 471.345, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 5b.  [WATER TANK SERVICE CONTRACTS.] A municipality 
  1.10  may, by direct negotiation through the solicitation of requests 
  1.11  for proposals, enter into a multiyear professional service 
  1.12  contract for the engineering, repair, and maintenance of a water 
  1.13  storage tank and appurtenant facilities owned, controlled, or 
  1.14  operated by the municipality, if the contract contains: 
  1.15     (1) a provision that the municipality is not required to 
  1.16  make total payments in a single year that exceed the water 
  1.17  utility charges received by the municipality for that year; 
  1.18     (2) a provision requiring that the work performed be done 
  1.19  under the review of a professional engineer licensed in the 
  1.20  state of Minnesota attesting that the work will be performed in 
  1.21  compliance with all applicable codes and engineering standards; 
  1.22  and 
  1.23     (3) a provision that if, at the commencement of the 
  1.24  contract, the water tank or appurtenant facilities requires 
  1.25  engineering, repair, or service in order to bring the water tank 
  2.1   or facilities into compliance with federal, state, or local 
  2.2   requirements, the party contracting with the municipality is 
  2.3   responsible for providing the engineering, repair, or service.  
  2.4   The costs to bring the water tank or facilities into compliance 
  2.5   must be itemized separately and charged to the municipality in 
  2.6   payments spread over a period of not less than three years from 
  2.7   the commencement of the contract. 
  2.8      Sec. 2.  [EFFECTIVE DATE.] 
  2.9      Section 1 is effective the day following final enactment.
