A bill for an act
relating to environment; creating resource management and assistance account;
depositing portion of solid waste tax into resource management and assistance
account; amending Minnesota Statutes 2018, section 16A.531, subdivision 1a;
proposing coding for new law in Minnesota Statutes, chapter 115A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 16A.531, subdivision 1a, is amended to read:


Subd. 1a.

Revenues.

The following revenues must be deposited in the environmental
fund:

(1) revenue from the motor vehicle transfer fee as provided in section 115A.908,
subdivision 2;

(2) all fees collected under section 116.07, subdivision 4d;

(3) all money collected by the Pollution Control Agency in enforcement matters as
provided in section 115.073;

(4) all revenues from license fees for subsurface sewage treatment systems under section
115.56;

(5) all loan repayments deposited under section 115A.0716;

(6) all revenue from pollution prevention fees imposed under section 115D.12;

(7) all loan repayments deposited under section 116.994;

(8) all fees collected under section 116C.834;

(9) revenue collected from the solid waste management tax pursuant to chapter 297Hnew text begin ,
of which 33 percent must be credited to the resource management and assistance account
under section 115A.571

(10) fees collected under section 473.844;

(11) interest accrued on the fund; and

(12) money received in the form of gifts, grants, reimbursement, or appropriation from
any source for any of the purposes provided in subdivision 2, except federal grants.

Sec. 2.

established as an account in the environmental fund.

new text begin A portion of the solid waste management tax revenue, as
determined under section 16A.531, subdivision 1a, clause (9), must be credited to the
account.

new text begin (a) The money in the account may be spent only for the following
purposes and only upon appropriation by the legislature:

new text begin (1) county waste reduction and recycling funding under section 115A.557;
new text end

new text begin (2) environmental assistance grants or loans under section 115A.0716;
new text end

new text begin (3) competitive grants to political subdivisions to increase recycling and composting
under section 115A.565;

new text begin (4) grants to develop and expand recycling markets for Minnesota businesses; and
new text end

new text begin (5) grants to reduce and divert food waste, redirect edible food for consumption, and
remove barriers to collecting and recovering organic waste.

new text begin (b) The commissioner must allocate at least 90 percent of the annual revenue credited
to the account for grants to counties under section 115A.557.
