A bill for an act
relating to health care; requiring pharmacists to dispense a prescription using an
audible container label or braille container label for patients who are visually
impaired or blind; amending Minnesota Statutes 2018, section 151.212, by adding
a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 151.212, is amended by adding a subdivision
to read:

new text begin Accessible prescription drug container labels. new text end

new text begin (a) A pharmacist must dispense
a prescription drug to a patient who is visually impaired or blind using an audible prescription
drug container label, or a braille prescription drug container label, unless the patient requests
a regular container label. The label must contain the information required under subdivisions
1 and 2.

new text begin (b) The pharmacy must not charge an extra fee or surcharge to the patient for providing
an audible or braille container label.

new text begin (c) This subdivision does not apply to drugs dispensed by a licensed veterinarian.
