  1.1                          A bill for an act 
  1.2             relating to employment; providing that wage credits 
  1.3             earned by certain school food service employees may be 
  1.4             used for unemployment benefit purposes; amending 
  1.5             Minnesota Statutes 2000, section 268.085, subdivision 
  1.6             8. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 268.085, 
  1.9   subdivision 8, is amended to read: 
  1.10     Subd. 8.  [SERVICES FOR SCHOOL CONTRACTORS.] (a) Except as 
  1.11  provided in paragraph (b), wage credits from an employer are 
  1.12  subject to subdivision 7, if:  
  1.13     (1) the employment was provided pursuant to a contract 
  1.14  between the employer and an elementary or secondary school; and 
  1.15     (2) the contract was for services that the elementary or 
  1.16  secondary school could have had performed by its employees.  
  1.17     (b) Wage credits from an employer are not subject to 
  1.18  subdivision 7 if they are earned during the school year by an 
  1.19  employee of a private employer pursuant to a contract between 
  1.20  the employer and an elementary or secondary school and the 
  1.21  employment was related to food services provided to the school 
  1.22  by the employer. 
  1.23     Sec. 2.  [EFFECTIVE DATE.] 
  1.24     Section 1 is effective the day following final enactment.
