A bill for an act
relating to public safety; providing temporary appointment of additional driver's
license agents to assist with REAL ID implementation; requiring a report;
appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin This section provides temporary assistance centers to assist
permanent driver's license agents with the anticipated increase in the number of Minnesota
residents seeking REAL ID compliant driver's licenses prior to the federal deadline for full
REAL ID Act implementation.

new text begin Temporary agreements for REAL ID Act implementation. new text end

new text begin (a)
Notwithstanding Minnesota Statutes, section 171.061, and Minnesota Rules, chapter 7404,
the commissioner of public safety may enter into agreements with the Board of Trustees of
the Minnesota State Colleges and Universities and the Board of Regents of the University
of Minnesota to provide temporary appointments to perform driver's license agent functions
under Minnesota Statutes, section 171.061.

new text begin (b) An agreement under paragraph (a) must be structured to facilitate effective
implementation of REAL ID Act of 2005 compliance under Minnesota Statutes, chapter
171, including application and documentation assistance for driver's license and Minnesota
identification card applicants. At a minimum, an agreement must provide for background
checks as required under Minnesota Statutes, section 171.017, hiring and training of
temporary employees, use of facilities, lease or purchase of equipment, and collection of
fees. An agreement must include an arrangement that establishes one or more temporary
offices located throughout the state.

new text begin (c) An agreement under paragraph (a) may authorize any of the entities entering into
the agreement to retain the filing fee revenue under Minnesota Statutes, section 171.061,
subdivision 4, provided the revenue is expended only for direct administrative costs to
implement driver's license agent functions.

new text begin The commissioner must make reasonable efforts to
ensure that temporary driver's license agents under this section are able to begin processing
applications by the date that the Department of Public Safety begins issuing driver's licenses
and Minnesota identification cards that fully comply with the REAL ID Act of 2005.

new text begin The authority to operate a temporary driver's license agent under
this section expires June 30, 2019.

new text begin By October 1, 2019, the commissioner of public safety
must submit a report detailing the agreements and REAL ID Act conformity implementation
under this section to the members and staff of the legislative committees with jurisdiction
over transportation policy and finance.

new text begin $....... in fiscal year 2018 is appropriated from the general fund
to the commissioner of public safety to implement temporary driver's license agent
agreements under this section. Notwithstanding Minnesota Statutes, section 16A.28, this
appropriation is available for three years after the year of appropriation. This is a onetime
appropriation.
