A bill for an act
relating to academic health care facilities; designating certain academic health care
facilities as essential to the University of Minnesota's public health mission.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin Land grant medical school and medical facilities. new text end

new text begin In recognition of
the importance to the state of the University of Minnesota Medical School, a public land
grant entity dedicated to medical education, research, and public service; the constitutional
foundation of the University of Minnesota's land grant mission; and the status of the publicly
supported academic health care facilities licensed by the Department of Health as the M
Health Fairview University of Minnesota Medical Center, those facilities are designated as
University of Minnesota health care facilities. Having been built and supported with
significant state funding and private philanthropic gifts to further the University of
Minnesota's land grant mission of educating, training, and serving the public, it is essential
that those facilities remain dedicated to the University of Minnesota's public health care
mission.

new text begin Restrictions on use. new text end

new text begin The University of Minnesota health care facilities, as
charitable assets devoted to the University of Minnesota's public land grant education and
research missions, may not be controlled, directly or indirectly, in whole or in part, by an
out of state entity. Consistent with the charitable restrictions on such facilities, the University
of Minnesota health care facilities, or any portion of such facilities, may only be sold by or
transferred to the Board of Regents of the University of Minnesota. Nothing in this
subdivision shall prevent the Board of Regents of the University of Minnesota from disposing
of one or more of the facilities comprising the University of Minnesota health care facilities,
provided that any proceeds from the disposition of such facilities remain dedicated to public
education and research.
