  1.1                          A bill for an act 
  1.2             relating to human services; defining a mental health 
  1.3             professional for the purpose of medical assistance 
  1.4             coverage; amending Minnesota Statutes 1998, sections 
  1.5             148B.32, subdivision 1; and 256B.0625, by adding a 
  1.6             subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 148B.32, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [UNLICENSED PRACTICE PROHIBITED.] After 
  1.11  adoption of rules by the board implementing sections 148B.29 to 
  1.12  148B.39, no individual shall engage in marriage and family 
  1.13  therapy practice unless that individual holds a valid license 
  1.14  issued under sections 148B.29 to 148B.39. 
  1.15     Marriage and family therapists may not be reimbursed under 
  1.16  medical assistance, chapter 256B, except to the extent such care 
  1.17  is reimbursed under section 256B.0625, subdivision 5, or when 
  1.18  marriage and family therapists are employed by a managed care 
  1.19  organization with a contract to provide mental health care to 
  1.20  medical assistance enrollees, and are reimbursed through the 
  1.21  managed care organization. 
  1.22     Sec. 2.  Minnesota Statutes 1998, section 256B.0625, is 
  1.23  amended by adding a subdivision to read: 
  1.24     Subd. 41.  [MENTAL HEALTH PROFESSIONAL.] Notwithstanding 
  1.25  Minnesota Rules, part 9505.0175, subpart 28, the definition of a 
  1.26  mental health professional shall include a person who is 
  2.1   qualified as specified in section 245.462, subdivision 18, 
  2.2   clause (5); or 245.4871, subdivision 27, clause (5), for the 
  2.3   purpose of this section and Minnesota Rules, parts 9505.0170 to 
  2.4   9505.0475.
