A bill for an act
relating to lawful gambling; modifying certain pull-tab restrictions and
requirements; amending Minnesota Statutes 2022, sections 349.1721, subdivision
3; 349.18, subdivision 4, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 349.1721, subdivision 3, is amended to read:


Subd. 3.

Pull-tab dispensing device location restrictions and requirements.

The
following pertain to pull-tab dispensing devices as defined under section 349.12, subdivision
32a.

(a) The use of any pull-tab dispensing device must be at a permitted premises which is:

(1) a licensed premises for on-sale of intoxicating liquor or 3.2 percent malt beverages;

(2) a premises where bingo is conducted as the primary business; or

(3) an establishment licensed for the off-sale of intoxicating liquor, other than drug stores
and general food stores licensed under section 340A.405, subdivision 1.

(b) The number of pull-tab dispensing devices located at any permitted premises is
limited to three.

new text begin (c) For bar operations, no more than nine pull-tab deals may be sold at any one time
from pull-tab dispensing devices located at the permitted premises.

Sec. 2.

Minnesota Statutes 2022, section 349.18, subdivision 4, is amended to read:


Subd. 4.

Prohibition.

(a) An organization may not pay rent to itself or to any of its
affiliates for use of space for conducting lawful gambling.

(b) An organization may not pay rent for space for conducting lawful gambling from
any account or fund other than the organization's separate gambling account.

new text begin (c) For bar operations, paper pull-tabs may not be sold or redeemed from a booth or
similar distinct, separate space and must be sold or redeemed where other bar and retail
sales occur at the leased premises.

new text begin (d) For bar operations, unless sold from a pull-tab dispensing device, no more than four
paper pull-tab deals may be in play at any one time.

new text begin (e) For bar operations, a lessor may not employ a person whose sole responsibility is to
sell and redeem paper pull-tabs or operate electronic pull-tab games at the licensed premises.

Sec. 3.

Minnesota Statutes 2022, section 349.18, is amended by adding a subdivision to
read:

exclusively by employees of the licensed organization, none of whom may also be employed
or compensated by the lessor.
