  1.1                          A bill for an act 
  1.2             relating to health; establishing a nursing home 
  1.3             planning and transition grant program; appropriating 
  1.4             money; proposing coding for new law in Minnesota 
  1.5             Statutes, chapter 144. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [144.1476] [NURSING HOME PLANNING AND 
  1.8   TRANSITION GRANT PROGRAM.] 
  1.9      Subdivision 1.  [DEFINITION.] "Eligible nursing home" means 
  1.10  any nursing home licensed under sections 144A.01 to 144A.16 and 
  1.11  certified by an appropriate authority under United States Code, 
  1.12  title 42, sections 1396-1396p, to participate as a vendor in the 
  1.13  medical assistance program established under chapter 256B. 
  1.14     Subd. 2.  [GRANTS AUTHORIZED.] The commissioner shall 
  1.15  establish a program of grants to assist eligible nursing homes.  
  1.16  The commissioner shall award grants to nursing homes for the 
  1.17  purposes set forth in paragraphs (a) and (b).  
  1.18     (a) Planning grants may be used by nursing homes to develop 
  1.19  strategic plans which identify the appropriate institutional and 
  1.20  noninstitutional settings necessary to meet the long-term care 
  1.21  needs of the community.  At a minimum, a strategic plan must 
  1.22  consist of:  
  1.23     (1) a needs assessment to determine what long-term care 
  1.24  services are needed and desired by the community; 
  1.25     (2) an assessment of the appropriate settings in which to 
  2.1   provide needed long-term care services; 
  2.2      (3) an assessment identifying currently available services 
  2.3   and their settings in the community; and 
  2.4      (4) a transition plan to achieve the needed outcome 
  2.5   identified by the assessment.  
  2.6      (b) Transition grants may be used by eligible nursing homes 
  2.7   to implement transition projects identified in a strategic 
  2.8   plan.  The purposes for which the grants may be used may include 
  2.9   capital improvements or the elimination of existing financing 
  2.10  barriers.  
  2.11     Subd. 3.  [ALLOCATION OF GRANTS.] (a) Eligible nursing 
  2.12  homes must apply to the commissioner no later than September 1 
  2.13  of each fiscal year for grants awarded for that fiscal year.  A 
  2.14  grant may be awarded upon signing of a grant contract.  
  2.15     (b) The commissioner must make a final decision on the 
  2.16  funding of each application within 60 days of the deadline for 
  2.17  receiving applications.  
  2.18     (c) In determining which nursing homes will receive grants 
  2.19  under this section, the commissioner shall consider the 
  2.20  following factors:  
  2.21     (1) the description of the problem, the project, and the 
  2.22  likelihood of the project meeting identified needs; 
  2.23     (2) a description by the applicant of achievable 
  2.24  objectives, timetables, and roles and capabilities of 
  2.25  responsible individuals and organizations; 
  2.26     (3) the extent of community support for the nursing home 
  2.27  and the proposed project, including other long-term care 
  2.28  providers and local community and government leaders; 
  2.29     (4) a balanced distribution of grants among geographic 
  2.30  regions and among small and large nursing homes; and 
  2.31     (5) the financial condition of the nursing home.  
  2.32     (d) A planning grant, as described in subdivision 2, 
  2.33  paragraph (a), given to a nursing home, including nursing homes 
  2.34  that submit applications as consortia, may not exceed $50,000.  
  2.35     (e) A transition grant, as described in subdivision 2, 
  2.36  paragraph (b), given to a nursing home, including nursing homes 
  3.1   that submit applications as consortia, may not exceed $500,000.  
  3.2   A nursing home receiving a transition grant may use the grant 
  3.3   for any expenses incurred through capital improvement or for the 
  3.4   purpose of debt retirement.  
  3.5      Subd. 4.  [EVALUATION.] The commissioner shall evaluate the 
  3.6   overall effectiveness of the grant program.  The commissioner 
  3.7   shall collect, from the nursing homes receiving grants, the 
  3.8   information necessary to evaluate the grant program.  
  3.9   Information related to the financial condition of individual 
  3.10  nursing homes shall be classified as nonpublic data.  
  3.11     Sec. 2.  [APPROPRIATION.] 
  3.12     $2,500,000 is appropriated annually from the general fund 
  3.13  to the commissioner of health to implement the nursing home 
  3.14  planning and transition grant program created in section 1.  Any 
  3.15  unencumbered balance remaining at the end of each year cancels 
  3.16  to the general fund.
