relating to workers' compensation; providing for workers' compensation
presumption reimbursement; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin WORKERS' COMPENSATION COVID-19 PRESUMPTION
REIMBURSEMENT.

new text begin The workers' compensation COVID-19 presumption
reimbursement fund is created in the state treasury to reimburse employees in job
classifications otherwise entitled to the presumption established by Laws 2020, chapter 72,
section 1, but for a date of injury occurring between January 1, 2022, and the day before
enactment of 2022 House File No. 1203, if enacted, whose COVID-19 claim is denied at
least in part due to unavailability of the presumption between January 1, 2022, and the day
before enactment of 2022 House File No. 1203, if enacted. Reimbursements shall be made
from the fund to eligible employees by the commissioner of labor and industry.

new text begin An employee described in subdivision 1 shall
submit to the commissioner in a format prescribed by the commissioner information regarding
the amounts to be reimbursed from the fund. The commissioner shall make reimbursements
to eligible employees on a first-come, first-served basis. No funds may be reimbursed after
December 31, 2022.

new text begin By February 15, 2023, the commissioner shall report to
the legislature regarding reimbursements paid to employees under this section.

Sec. 2. new text begin APPROPRIATION; WORKERS' COMPENSATION COVID-19
PRESUMPTION REIMBURSEMENTS.

new text begin $....... in fiscal year 2022 is appropriated from the workers' compensation fund to the
commissioner of management and budget for deposit in the workers' compensation
COVID-19 reimbursement fund to provide reimbursements as specified in section 1. This
is a onetime appropriation. Funds are available until December 31, 2022.
