  1.1                          A bill for an act 
  1.2             relating to education; delaying use of the Test of 
  1.3             Emerging Academic English to identify limited English 
  1.4             proficient pupils. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [TEST OF EMERGING ACADEMIC ENGLISH; LEP 
  1.7   PUPILS.] 
  1.8      Notwithstanding Minnesota Statutes 2001 Supplement, section 
  1.9   124D.59, subdivision 2, clause (3), the commissioner of 
  1.10  children, families, and learning shall delay, for three years 
  1.11  until the 2005-2006 school year, the use of the Test of Emerging 
  1.12  Academic English (TEAE) as an assessment measure to identify 
  1.13  pupils of limited English proficiency.  During this time, the 
  1.14  commissioner shall study the TEAE to determine its effectiveness 
  1.15  as an assessment measure to identify limited English proficient 
  1.16  pupils.  The commissioner shall report its findings to the 
  1.17  education committees of the legislature by February 15, 2005. 
  1.18     [EFFECTIVE DATE.] This section is effective the day 
  1.19  following final enactment.
