A bill for an act
 relating to transportation; modifying provisions relating to certain positions
in Department of Transportation; amending Minnesota Statutes 2006, section
174.02, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 174.02, subdivision 2, is amended to read:


Subd. 2.

Unclassified positions.

The commissioner new text begin shall appoint a deputy
commissioner/chief engineer. The deputy commissioner/chief engineer must be licensed
as a professional engineer under Minnesota Statutes, section 326.02. A commissioner
who is licensed as a professional engineer under section 326.02, may appoint a deputy
commissioner who is not a licensed professional engineer. The commissioner new text end may
establish deleted text begin fourdeleted text end new text begin three othernew text end positions in the unclassified service at the deputy and assistant
commissioner, assistant to commissionernew text begin ,new text end or personal secretary levels. No more than two
of these positions shall be at the deputy commissioner level.
