  1.1                          A bill for an act 
  1.2             relating to eminent domain; increasing the limit for 
  1.3             reimbursement of appraisal fees; amending Minnesota 
  1.4             Statutes 2000, section 117.232, subdivision 1. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 117.232, 
  1.7   subdivision 1, is amended to read: 
  1.8      Subdivision 1.  When acquisition of private property is 
  1.9   accomplished by the state department of transportation by direct 
  1.10  purchase the owner shall be entitled to reimbursement for 
  1.11  appraisal fees, not to exceed a total of $500 $1500.  When 
  1.12  acquisition of private property is accomplished by any other 
  1.13  acquiring authority, the owner is entitled to reimbursement for 
  1.14  appraisal fees, not to exceed $500 $1500, if the owner is 
  1.15  otherwise entitled to reimbursement under sections 117.50 to 
  1.16  117.56.  The purchaser in all instances shall inform the owner 
  1.17  of the right, if any, to reimbursement for appraisal fees 
  1.18  reasonably incurred, in an amount not to exceed $500 $1500, 
  1.19  together with relocation costs, moving costs and any other 
  1.20  related expenses to which an owner is entitled by sections 
  1.21  117.50 to 117.56.  This subdivision does not apply to 
  1.22  acquisition for utility purposes made by a public service 
  1.23  corporation organized pursuant to section 300.03 or electric 
  1.24  cooperative associations organized pursuant to chapter 308A. 
  1.25     Sec. 2.  [EFFECTIVE DATE.] 
  2.1      Section 1 is effective July 1, 2002.
