  1.1                          A bill for an act 
  1.2             relating to human services; providing for notification 
  1.3             of claim errors; amending Minnesota Statutes 1996, 
  1.4             section 16A.124, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 16A.124, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 4c.  [INVOICE ERRORS; DEPARTMENT OF HUMAN SERVICES; 
  1.9   HOME CARE.] For purposes of department of human services 
  1.10  payments to home care services providers receiving reimbursement 
  1.11  under the medical assistance program; general assistance medical 
  1.12  care program; home and community-based waiver services under 
  1.13  section 256B.501; home and community-based services for the 
  1.14  elderly under section 256B.0915; community alternatives for 
  1.15  disabled individuals waiver services under section 256B.49; 
  1.16  community alternative care waiver services under section 
  1.17  256B.49; and traumatic brain injury waiver services under 
  1.18  section 256B.49, if an invoice is incorrect, defective, or 
  1.19  otherwise improper, the department of human services must notify 
  1.20  the home care services provider of all errors within 30 days of 
  1.21  submission of a claim.  Any notification must be in writing and 
  1.22  specify the specific codes or problems which are incorrect, 
  1.23  defective, or otherwise improper; employ a request for 
  1.24  additional information based on Medicare Form 488; provide a 
  1.25  time frame for response; and provide the name and telephone 
  2.1   number of a department contact person.  Failure by the 
  2.2   department to provide notification as to a claim shall result in 
  2.3   the claim being deemed a valid vendor obligation.
