  1.1                          A bill for an act 
  1.2             relating to state lands; modifying the terms of a 
  1.3             tax-forfeited land sale in Carlton county; authorizing 
  1.4             the private sale of certain land in Aitkin county; 
  1.5             authorizing the conveyance of certain state land to 
  1.6             the city of Faribault; authorizing the public sale of 
  1.7             certain tax-forfeited land that borders public water 
  1.8             in Douglas county; amending Laws 1997, chapter 207, 
  1.9             section 7. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Laws 1997, chapter 207, section 7, is amended 
  1.12  to read: 
  1.13     Sec. 7.  [PRIVATE SALE OF TAX-FORFEITED LAND; CARLTON 
  1.14  COUNTY.] 
  1.15     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
  1.16  282.018, subdivision 1, and the public sale provisions of 
  1.17  Minnesota Statutes, chapter 282, Carlton county may sell by 
  1.18  private sale the tax-forfeited land described in paragraph (d) 
  1.19  under the remaining provisions of Minnesota Statutes, chapter 
  1.20  282. 
  1.21     (b) The land described in paragraph (d) may be sold by 
  1.22  private sale.  The consideration for the conveyance must include 
  1.23  the taxes due on the property and any penalties, interest, and 
  1.24  costs shall be the appraised value of the land.  If the lands 
  1.25  are sold, the conveyance must reserve to the state a 
  1.26  conservation perpetual easement, in a form prescribed by the 
  1.27  commissioner of natural resources, for the land within 100 feet 
  2.1   of the ordinary high water level of Slaughterhouse creek for 
  2.2   public angler access and stream habitat protection and 
  2.3   enhancement for the benefit of the state of Minnesota, 
  2.4   department of natural resources, over the following lands: 
  2.5      A strip of land lying in the North 6.66 acres of the West 
  2.6   Half of the Northeast Quarter of the Southwest Quarter of 
  2.7   Section 6, Township 48 North, Range 16 West, Carlton county.  
  2.8   Said strip lying 100 feet on each side of the centerline of 
  2.9   Slaughterhouse Creek. 
  2.10     (c) The conveyance must be in a form approved by the 
  2.11  attorney general. 
  2.12     (d) The land to be conveyed is located in Carlton county 
  2.13  and is described as: 
  2.14     North 6.66 acres of the West Half of the Northeast Quarter 
  2.15  of the Southwest Quarter, subject to pipeline easement, Section 
  2.16  6, Township 48 North, Range 16 West, City of Carlton. 
  2.17     (e) Carlton county has determined that this sale best 
  2.18  serves the land management interests of Carlton county. 
  2.19     Sec. 2.  [AITKIN COUNTY; PRIVATE SALE.] 
  2.20     (a) Notwithstanding Minnesota Statutes, sections 94.09 to 
  2.21  94.16, the commissioner of natural resources may sell by private 
  2.22  sale for a consideration of not less than the appraised value, 
  2.23  excluding improvements, to the holder of the life estate in the 
  2.24  tract of land described in paragraph (c).  
  2.25     (b) The sale shall be in a form approved by the attorney 
  2.26  general.  
  2.27     (c) The land to be sold is in Aitkin county, Minnesota in 
  2.28  the Vendla Badger wildlife management area and is described as: 
  2.29     That part of the Southwest Quarter of the Southeast Quarter 
  2.30  of Section 12, Township 46 North, Range 26 West, Aitkin county, 
  2.31  Minnesota, described as follows:  
  2.32     Commencing at a 1-1/4 inch iron pipe at the south quarter 
  2.33  corner of said Section 12; thence EAST, bearing assumed, on the 
  2.34  south line of said Section 12, a distance of 141.85 feet to the 
  2.35  point of beginning; thence NORTH 725.00 feet; thence EAST 450.00 
  2.36  feet; thence SOUTH 725.00 feet to said south line; thence WEST 
  3.1   on said south line 450.00 feet to the point of beginning; 
  3.2   containing 7.5 acres, more or less.  
  3.3      (d) The buyer's predecessor donated land to the state for 
  3.4   the Vendla Badger wildlife management area, including the land 
  3.5   described in paragraph (c), but retained a possessory interest 
  3.6   in the land described in paragraph (c).  The sale gives the 
  3.7   buyer full title free of state interest. 
  3.8      Sec. 3.  [CONVEYANCE OF STATE LAND TO CITY OF FARIBAULT.] 
  3.9      Subdivision 1.  [CONVEYANCE.] Notwithstanding Minnesota 
  3.10  Statutes, sections 92.45 and 94.09 to 94.16, the commissioner of 
  3.11  administration shall convey to the city of Faribault for no 
  3.12  consideration the land described in subdivision 3. 
  3.13     Subd. 2.  [FORM.] The conveyance must be in a form approved 
  3.14  by the attorney general and must provide that the land reverts 
  3.15  to the state if Parcels A and B cease to be used for a nature 
  3.16  interpretive center and recreational trail system or if Parcel C 
  3.17  ceases to be used for a municipal park. 
  3.18     Subd. 3.  [DESCRIPTION.] (a) The land to be conveyed are 
  3.19  those parts of Sections 31, 32, and 33 in Township 110 North, 
  3.20  Range 20 West, and those parts of Sections 4, 5, 6, and 8 in 
  3.21  Township 109 North, Range 20 West, in the city of Faribault, 
  3.22  Rice county, Minnesota, described as follows: 
  3.23     (1) Parcel A:  Beginning at the Southeast corner of the 
  3.24     Southeast Quarter of said Section 31; thence South 89 
  3.25     degrees, 58 minutes, 35 seconds West, along the South line 
  3.26     of said Southeast Quarter (for purposes of this description 
  3.27     bearings are assumed and based on said South line being

 10.33     point in the East line of vacated State Avenue; thence 
 10.34     North 0 degrees, 4 minutes, 9 seconds East, along said East 
 10.35     line of vacated State Avenue, 360.00 feet to the Southwest

 11.3      (b) The following land is excepted from the land described 
 11.4   in paragraph (a): 
 11.5      (1) Parcel D:  That part of the North One-half of the 
 11.6      Northeast Quarter of Section 6 and that part of the North 
 11.7      One-half of the Northwest Quarter of Section 5, all in 
 11.8      Township 109 North, Range 20 West, in the city of 
 11.9      Faribault, Rice county, Minnesota, described as follows:  
 11.10     Beginning at a point in the East line of said Northeast 
 11.11     Quarter of Section 6 (for purposes of this description 
 11.12     bearings are assumed and based on said East line being 
 11.13     South 0 degrees, 37 minutes, 43 seconds West), a distance 
 11.14     of 1309.61 feet southerly from the Northeast corner of said 
 11.15     Northeast Quarter; thence South 86 degrees, 27 minutes, 58 
 11.16     seconds West, 153.73 feet; thence North 0 degrees, 13 
 11.17     minutes, 34 seconds East, 252.29 feet; thence South 89 
 11.18     degrees, 34 minutes, 30 seconds East, 82.53 feet to a point 
 11.19     in the southwesterly right-of-way line of the Chicago, Rock 
 11.20     Island and Pacific railroad; thence southeasterly, along 
 11.21     said railroad right-of-way line, on a curve, concave 
 11.22     northeasterly (curve data:  radius = 2914.77 feet; delta 
 11.23     angle = 5 degrees, 27 minutes, 8 seconds; chord bearing and 
 11.24     distance = South 30 degrees, 58 minutes, 52 seconds East, 
 11.25     277.26 feet), an arc distance of 277.37 feet; thence South

 11.27     point of beginning; and 
 11.28     (2) the property deeded to the Chicago, Rock Island and 
 11.29     Pacific railroad, and City of Faribault Trail. 
 11.30     (c) The land described in paragraph (a) is subject to: 
 11.31     (1) Glynview Trail (county state aid highway 19) over the 
 11.32     southwesterly side thereof; 
 11.33     (2) 220th Street East over part of the southerly side of 
 11.34     Section 5; 
 11.35     (3) Fifth Street Northeast over part of the northerly side 
 11.36     of the South One-quarter of the Southeast Quarter of 
 12.1      Section 32; 
 12.2      (4) an easement for ingress and egress over and across 
 12.3      Parcel B, said easement being a strip of land 30.00 feet in 
 12.4      width lying immediately adjacent to and southwesterly of 
 12.5      the southwesterly right-of-way line of said Chicago, Rock 
 12.6      Island and Pacific railroad, bounded on the North by the 
 12.7      southerly line of Parcel D, and bounded on the East by a 
 12.8      line 49.50 feet westerly of and parallel with said East 
 12.9      line of the Southwest Quarter of the Northwest Quarter of 
 12.10     Section 5; and 
 12.11     (5) an easement for access to and maintenance of a deep 
 12.12     sewer tunnel over, under, and across part of Parcel B, 
 12.13     being a strip of land 100.00 feet in width, 50.00 feet on 
 12.14     both sides of the following described center line:  
 12.15     Commencing at said Point A in Parcel B; thence North 56 
 12.16     degrees, 4 minutes, 42 seconds East, 267.00 feet to the 
 12.17     point of beginning of said easement center line; thence 
 12.18     South 53 degrees, 14 minutes, 0 seconds East, 300.00 feet 
 12.19     and there terminating; the side lines of said easement to 
 12.20     be lengthened or shortened to meet in said course herein 
 12.21     described as North 56 degrees, 4 minutes, 42 seconds East. 
 12.22     Subd. 4.  [PURPOSE.] The land to be conveyed is no longer 
 12.23  utilized by the department of corrections in Faribault.  The 
 12.24  city of Faribault intends to continue to use Parcels A and B for 
 12.25  a nature interpretive center and recreational trail system and 
 12.26  Parcel C for a municipal park. 
 12.27     Sec. 4.  [SALE OF TAX-FORFEITED LAND; DOUGLAS COUNTY.] 
 12.28     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
 12.29  282.018, subdivision 1, Douglas county may sell the 
 12.30  tax-forfeited land bordering public water that is described in 
 12.31  paragraph (c), under the remaining provisions of Minnesota 
 12.32  Statutes, chapter 282. 
 12.33     (b) The conveyance must be in a form approved by the 
 12.34  attorney general.  Consideration shall be for not less than the 
 12.35  appraised value as determined by the Douglas county board. 
 12.36     (c) The land to be sold is located in Douglas county and is 
 13.1   described as: 
 13.2      Lot 43, block 1, Christinas Moon Lake Heights, section 28, 
 13.3      Township 129 North, Range 39 West. 
 13.4      (d) The county has determined that the county's land 
 13.5   management interests would best be served if the land was 
 13.6   returned to private ownership. 
 13.7      Sec. 5.  [EFFECTIVE DATE.] 
 13.8      Sections 1 and 2 are effective the day following final 
 13.9   enactment.
