  1.1                          A bill for an act 
  1.2             relating to transportation; limiting duration of 
  1.3             drivers' licenses and Minnesota identification cards 
  1.4             for noncitizens with short-term admission 
  1.5             authorization; amending Minnesota Statutes 2000, 
  1.6             sections 171.07, subdivision 4; 171.27. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 171.07, 
  1.9   subdivision 4, is amended to read: 
  1.10     Subd. 4.  [EXPIRATION.] (a) Except as otherwise provided in 
  1.11  this subdivision, the expiration date of Minnesota 
  1.12  identification cards of applicants under the age of 65 shall be 
  1.13  is the birthday of the applicant in the fourth year following 
  1.14  the date of issuance of the card. 
  1.15     (b) Except as provided in paragraph (d), Minnesota 
  1.16  identification cards issued to applicants age 65 or over shall 
  1.17  be are valid for the lifetime of the applicant. 
  1.18     (c) Except if expiration would occur earlier under 
  1.19  paragraph (d), the expiration date for an Under-21 
  1.20  identification card is the card holder's 21st birthday.  The 
  1.21  commissioner shall issue an identification card to a holder of 
  1.22  an Under-21 identification card who applies for the card, pays 
  1.23  the required fee, and presents proof of identity and age, unless 
  1.24  the commissioner determines that the applicant is not qualified 
  1.25  for the identification card. 
  1.26     (d) Unless expiration would occur earlier under another 
  2.1   provision of this subdivision, if the applicant is not a citizen 
  2.2   of the United States or a permanent resident alien, the 
  2.3   applicant's Minnesota identification card expires on the 
  2.4   expiration date or completion date of the applicant's visa or 
  2.5   other short-term admission document issued to the applicant by 
  2.6   the United States government evidencing to the commissioner's 
  2.7   satisfaction permission for the applicant to be in this country. 
  2.8      Sec. 2.  Minnesota Statutes 2000, section 171.27, is 
  2.9   amended to read: 
  2.10     171.27 [EXPIRATION OF LICENSE.] 
  2.11     (a) Except as otherwise provided in this section, the 
  2.12  expiration date for each driver's license, other than under-21 
  2.13  licenses, is the birthday of the driver in the fourth year 
  2.14  following the date of issuance of the license.  The birthday of 
  2.15  the driver shall must be as indicated on the application for a 
  2.16  driver's license.  A license may be renewed on or before 
  2.17  expiration or within one year after expiration upon application, 
  2.18  payment of the required fee, and passing the examination 
  2.19  required of all drivers for renewal.  The commissioner shall 
  2.20  extend or renew driving privileges shall be extended or renewed 
  2.21  on or preceding the expiration date of an existing driver's 
  2.22  license unless the commissioner believes that the licensee (1) 
  2.23  is no longer qualified as a driver or (2) does not have 
  2.24  permission to remain in the United States throughout the 
  2.25  extension or renewal period.  
  2.26     (b) Except if expiration would occur earlier under 
  2.27  paragraph (f), the expiration date for each under-21 
  2.28  license shall be is the 21st birthday of the licensee.  Upon the 
  2.29  licensee attaining the age of 21 and upon the application, 
  2.30  payment of the required fee, and passing the examination 
  2.31  required of all drivers for renewal, a driver's license shall 
  2.32  must be issued unless the commissioner determines that the 
  2.33  licensee (1) is no longer qualified as a driver or (2) does not 
  2.34  have permission to remain in the United States throughout the 
  2.35  renewal period. 
  2.36     (c) Notwithstanding paragraphs (a) and (b), the 
  3.1   commissioner shall extend or renew driving privileges for a 
  3.2   period of six months for an applicant who does not have 
  3.3   permission to remain in the United States throughout the full 
  3.4   extension or renewal period, if the applicant demonstrates by a 
  3.5   statement from an agency of the United States government, or 
  3.6   otherwise to the satisfaction of the commissioner, that an 
  3.7   application to renew or extend a visa and other short-term 
  3.8   admission document is pending with an agency of the United 
  3.9   States government. 
  3.10     (d) Except if expiration would occur earlier under 
  3.11  paragraph (f), the expiration date for each provisional license 
  3.12  is two years after the date of application for the provisional 
  3.13  license. 
  3.14     (e) Any valid Minnesota driver's license issued to a person 
  3.15  then or subsequently on active duty with the Armed Forces of the 
  3.16  United States, or the person's spouse, shall continue in full 
  3.17  force and effect without requirement for renewal until 90 days 
  3.18  after the date of the person's discharge from such active 
  3.19  service, provided that a spouse's license must be renewed if the 
  3.20  spouse is residing within the state at the time the license 
  3.21  expires or within 90 days after the spouse returns to Minnesota 
  3.22  and resides within the state. 
  3.23     (f) Unless expiration would occur earlier under another 
  3.24  provision of this section, if the applicant is not a citizen of 
  3.25  the United States or a permanent resident alien, the applicant's 
  3.26  driver's license, permit to operate a motor vehicle, or driving 
  3.27  privilege of any nature or type expires on the expiration date 
  3.28  or completion date of the applicant's visa or other short-term 
  3.29  admission document issued to the applicant by the United States 
  3.30  government evidencing to the commissioner's satisfaction 
  3.31  permission for the applicant to be in this country.
