  1.1                          A bill for an act 
  1.2             relating to health; modifying MinnesotaCare 
  1.3             eligibility requirements; amending Minnesota Statutes 
  1.4             2000, section 256L.07, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 256L.07, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 5.  [EXEMPTION; INVOLUNTARY TERMINATION.] (a) A 
  1.9   family or individual is exempt from the requirements of 
  1.10  subdivisions 2 and 3 if application for MinnesotaCare is made 
  1.11  upon the involuntary loss of a job and involuntary termination 
  1.12  of employer-subsidized health coverage.  A family or individual 
  1.13  is eligible for MinnesotaCare under this subdivision without 
  1.14  accepting available continuation coverage. 
  1.15     (b) For purposes of this subdivision, "involuntary 
  1.16  termination of employer-subsidized health coverage" means the 
  1.17  unavailability of employer-subsidized health coverage after an 
  1.18  employee is permanently laid off, an employer declares 
  1.19  bankruptcy, or an employer ceases to do business.  Involuntary 
  1.20  termination of employer-subsidized health coverage does not 
  1.21  include loss of employer-subsidized health coverage after an 
  1.22  employee is fired.
