  1.1                          A bill for an act 
  1.2             relating to commerce; prohibiting sales of cigarettes 
  1.3             packed in units smaller than ten packages in 
  1.4             accessible displays; amending Minnesota Statutes 1997 
  1.5             Supplement, section 461.18, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.8   461.18, subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [EXCEPT IN ADULT-ONLY FACILITIES.] (a) No 
  1.10  person shall offer for sale single packages of cigarettes 
  1.11  packaged in units smaller than a carton containing ten packages 
  1.12  or single packages of smokeless tobacco in open displays which 
  1.13  are accessible to the public without the intervention of a store 
  1.14  employee. 
  1.15     (b) Cartons and other multipack units may be offered and 
  1.16  sold through open displays accessible to the public. 
  1.17     (c) Paragraph (b) expires on August 28, 1997. 
  1.18     (d) This subdivision shall not apply to retail stores which 
  1.19  derive at least 90 percent of their revenue from tobacco and 
  1.20  tobacco-related products and which cannot be entered at any time 
  1.21  by persons younger than 18 years of age. 
  1.22     Sec. 2.  [EFFECTIVE DATE.] 
  1.23     Section 1 is effective after June 30, 1998.
