  1.1                          A bill for an act 
  1.2             relating to tax increment financing; changing 
  1.3             limitations on including certain agricultural or open 
  1.4             space parcels in tax increment districts; amending 
  1.5             Minnesota Statutes 1995 Supplement, section 469.176, 
  1.6             subdivision 7. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.9   469.176, subdivision 7, is amended to read: 
  1.10     Subd. 7.  [PARCELS NOT INCLUDABLE IN DISTRICTS.] (a) The 
  1.11  authority may not request inclusion in a tax increment financing 
  1.12  district and the county auditor may not certify the original tax 
  1.13  capacity of the following: 
  1.14     (1) a parcel or a part of a parcel that qualified under the 
  1.15  provisions of section 273.111 or 273.112 or chapter 473H for 
  1.16  taxes payable in any of the five calendar years before the 
  1.17  filing of the request for certification, if the parcel is 
  1.18  located in the metropolitan area, as defined in section 473.121; 
  1.19  or 
  1.20     (2) a parcel or a part of a parcel, located outside of the 
  1.21  metropolitan area, as defined in section 473.121, that qualified 
  1.22  under the provisions of section 273.111 or 273.112 for taxes 
  1.23  payable in any of the five calendar years before the request for 
  1.24  certification, if the district is not a district in which 85 
  1.25  percent or more of the planned buildings and facilities 
  1.26  (determined on the basis of square footage) are for 
  2.1   manufacturing or production of tangible personal property, 
  2.2   including processing resulting in the change in condition of the 
  2.3   property.
