  1.1                          A bill for an act
  1.2             relating to education; allowing a school board and 
  1.3             school principals to negotiate a plan for terminating, 
  1.4             demoting, and reinstating principals; amending 
  1.5             Minnesota Statutes 2002, sections 122A.40, by adding a 
  1.6             subdivision; 122A.41, by adding a subdivision.  
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 122A.40, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 10a.  [NEGOTIATED PLAN FOR TERMINATING AND DEMOTING 
  1.11  PRINCIPALS.] The school board and the exclusive bargaining 
  1.12  representative of the principals may negotiate a plan for 
  1.13  terminating, demoting, and reinstating a principal due to 
  1.14  discontinuing the position or lacking pupils.  
  1.15     [EFFECTIVE DATE.] This section is effective for the 
  1.16  2004-2005 school year. 
  1.17     Sec. 2.  Minnesota Statutes 2002, section 122A.41, is 
  1.18  amended by adding a subdivision to read: 
  1.19     Subd. 5b.  [NEGOTIATED PLAN FOR TERMINATING AND DEMOTING 
  1.20  PRINCIPALS.] The school board and the exclusive bargaining 
  1.21  representative of the principals may negotiate a plan for
