  1.1                          A bill for an act 
  1.2             relating to fire protection; authorizing certain 
  1.3             installations by licensed plumbers; amending Minnesota 
  1.4             Statutes 2000, section 299M.03. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2000, section 299M.03, is 
  1.7   amended to read: 
  1.8      299M.03 [LICENSE OR CERTIFICATE REQUIRED.] 
  1.9      Subdivision 1.  [CONTRACTOR LICENSE.] Except for 
  1.10  residential installations in a one- or two-family dwelling by a 
  1.11  plumber licensed in accordance with section 326.40, subdivision 
  1.12  1, or by the owner of an occupied one- or two-family dwelling, a 
  1.13  person may not sell, design, install, modify, or inspect a fire 
  1.14  protection system, its parts, or related equipment, or offer to 
  1.15  do so, unless annually licensed to perform these duties as a 
  1.16  fire protection contractor.  No license is required under this 
  1.17  section for a person licensed as a professional engineer under 
  1.18  section 326.03 who is competent in fire protection system design 
  1.19  or a person licensed as an alarm and communication contractor 
  1.20  under section 326.2421 for performing activities authorized by 
  1.21  that license. 
  1.22     Subd. 2.  [JOURNEYMAN CERTIFICATE.] Except for residential 
  1.23  installations in a one- or two-family dwelling by a plumber 
  1.24  licensed in accordance with section 326.40, subdivision 1, or by 
  1.25  the owner of an occupied one- or two-family dwelling, a person 
  2.1   may not install, connect, alter, repair, or add to a fire 
  2.2   protection system, under the supervision of a fire protection 
  2.3   contractor, unless annually certified to perform those duties as 
  2.4   a journeyman sprinkler fitter or as a registered apprentice 
  2.5   sprinkler fitter.  This subdivision does not apply to a person 
  2.6   altering or repairing a fire protection system if the system 
  2.7   uses low pressure water and the system is located in a facility 
  2.8   regulated under the federal Mine Occupational Safety and Health 
  2.9   Act.
