A bill for an act
relating to transportation; establishing certain requirements concerning
completion of construction projects on marked Trunk Highway 14.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin Definitions. new text end

new text begin For purposes of this section, the following terms have
the meanings given:

new text begin (1) "commissioner" means the commissioner of the Department of Transportation;

new text begin (2) "department" means the Department of Transportation; and
new text end

new text begin (3) "Trunk Highway 14 projects" means construction or reconstruction of marked
Trunk Highway 14 as a four-lane divided highway, along the following segments:

new text begin (i) from the city of New Ulm to the intersection with Nicollet County State-Aid
Highway 6, located west of the city of North Mankato; and

new text begin (ii) from the interchange with marked Trunk Highway 218 near the city of Owatonna
to the point near the city of Dodge Center at which marked Trunk Highway 14 constitutes
a four-lane divided highway, located southeast of the intersection with marked Trunk
Highway 56.

new text begin (a) By December 31, 2010, the
commissioner shall submit the final environmental impact statement for the segment of
marked Trunk Highway 14 from the city of New Ulm to the intersection with Nicollet
County State-Aid Highway 6 to the Federal Highway Administration in the United States
Department of Transportation.

new text begin (b) By May 31, 2010, the commissioner shall submit the final environmental impact
statement for the segment of marked Trunk Highway 14 from the interchange with
marked Trunk Highway 218 near the city of Owatonna to southeast of the intersection
with marked Trunk Highway 56 near the city of Dodge Center to the Federal Highway
Administration in the United States Department of Transportation.

new text begin (c) Following final approvals for the Trunk Highway 14 projects as required under
state and federal law, the commissioner shall include the projects in the next regular
update to the statewide transportation improvement program. The Trunk Highway
14 projects must remain in the statewide transportation improvement program until
they are completed, and they may not be delayed from their initial date of scheduled
commencement unless the commissioner (1) identifies special unforeseen circumstances
and (2) submits a notification, including specific reasons for the delay, to the chairs and
ranking minority members of the house of representatives and senate committees with
jurisdiction over transportation policy and finance.

new text begin The commissioner shall perform the duties
required under this section within existing appropriations allocated to the department's
transportation districts 6 and 7, respectively. The requirements under this section do not
change the trunk highway funding allocation process or formula used by the department,
or the amount otherwise allocated to each transportation district.
