  1.1                          A bill for an act 
  1.2             relating to health services; requiring the 
  1.3             commissioner of human services to develop a plan to 
  1.4             certify out-of-state facilities that care for children 
  1.5             with severe emotional disturbance. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [PLAN TO CERTIFY OUT-OF-STATE FACILITIES THAT 
  1.8   CARE FOR CHILDREN WITH SEVERE EMOTIONAL DISTURBANCE.] 
  1.9      The commissioner of human services shall develop a plan to 
  1.10  expand the provisions of Minnesota Statutes, section 256B.0945, 
  1.11  to allow medical assistance to reimburse counties for children's 
  1.12  mental health residential treatment services provided in 
  1.13  out-of-state facilities.  The commissioner's plan must include a 
  1.14  certification procedure in lieu of state licensing for 
  1.15  out-of-state facilities and a method to set rates for 
  1.16  out-of-state care comparable to those paid for care provided by 
  1.17  in-state facilities.  The plan is due to the house of 
  1.18  representatives and senate committees having jurisdiction over 
  1.19  human services issues by January 15, 2003.
