  1.1                          A bill for an act 
  1.2             relating to counties; Itasca, St. Louis, and 
  1.3             Koochiching; increasing or establishing the per capita 
  1.4             spending limit for promotion of tourist, agricultural, 
  1.5             and industrial development; providing for distribution 
  1.6             of proceeds from forfeited land sales; making a 
  1.7             technical correction by restoring legal text 
  1.8             inadvertently made into a headnote in 1975; amending 
  1.9             Laws 1965, chapter 326, section 1, subdivision 5, as 
  1.10            amended; Laws 1967, chapter 170, section 1, 
  1.11            subdivision 5, as amended. 
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  Laws 1965, chapter 326, section 1, subdivision 
  1.14  5, as amended by Laws 1975, chapter 110, section 1, Laws 1985, 
  1.15  chapter 87, section 3, and Laws 1998, chapter 389, article 11, 
  1.16  section 11, is amended to read: 
  1.17     Subd. 5.  [PROMOTION OF TOURIST, AGRICULTURAL AND 
  1.18  INDUSTRIAL DEVELOPMENT.] Promotion of tourist, agricultural and 
  1.19  industrial development.  The amount to be spent annually for the 
  1.20  purposes of this subdivision shall not exceed $4 $10 per capita 
  1.21  of the county's population. 
  1.22     Sec. 2.  Laws 1967, chapter 170, section 1, subdivision 5, 
  1.23  as amended by Laws 1985, chapter 87, section 6, and Laws 1998, 
  1.24  chapter 389, article 11, section 12, is amended to read: 
  1.25     Subd. 5.  Promotion of tourist, agricultural and industrial 
  1.26  developments.  The amount to be spent annually for the purposes 
  1.27  of this subdivision shall not exceed $4 $10 per capita of the 
  1.28  county's population. 
  2.1      Sec. 3.  [ST. LOUIS COUNTY; FORFEITED LAND; PROCEEDS.] 
  2.2      Subdivision 1.  [AUTHORITY; PURPOSES.] Notwithstanding the 
  2.3   provisions of Minnesota Statutes, section 282.08, clause (4), 
  2.4   the county board of St. Louis county, out of the proceeds from 
  2.5   the sale or rental of any parcel of forfeited land, or from the 
  2.6   sale of any products from that land after making the payments 
  2.7   directed by Minnesota Statutes, section 282.08, clauses (1), 
  2.8   (2), and (3), may annually by resolution set aside an amount not 
  2.9   exceeding 30 percent of the receipts remaining, including 
  2.10  undistributed receipts remaining in the fund on the effective 
  2.11  date of this act for any of the purposes in subdivisions 2 to 5. 
  2.12     Subd. 2.  [TIMBER DEVELOPMENT; MEMORIAL FORESTS.] Timber 
  2.13  development on tax-forfeited land and dedicated memorial forests 
  2.14  to be expended under the supervision of the county board on 
  2.15  projects approved by the commissioner of natural resources. 
  2.16     Subd. 3.  [LAND USE PLANNING.] Land use planning programs 
  2.17  being carried on in the county including the enforcement of any 
  2.18  controls developed in said program. 
  2.19     Subd. 4.  [COUNTY PARKS AND RECREATION AREAS.] Acquisition 
  2.20  and maintenance of county parks or recreational areas as defined 
  2.21  in Minnesota Statutes, sections 398.31 to 398.36. 
  2.22     Subd. 5.  [TOURIST, AGRICULTURAL, AND ECONOMIC 
  2.23  DEVELOPMENT.] Promotion of tourist, agricultural, and economic 
  2.24  development.  The amount to be spent annually for the purposes 
  2.25  of this subdivision must not exceed $4 per capita of the 
  2.26  county's population. 
  2.27     Subd. 6.  [USE FOR STATE OR FEDERAL PROGRAMS.] Any funds 
  2.28  set aside by the county board pursuant to subdivisions 2 to 5 
  2.29  may be used by the county board as the county's share in any 
  2.30  state or federal aid program relating to the purposes stated in 
  2.31  subdivisions 2 to 5. 
  2.32     Subd. 7.  [APPORTIONMENT.] Any balance shall be apportioned 
  2.33  as follows:  county, 40 percent; town or city, 20 percent; and 
  2.34  school district, 40 percent.  But in unorganized territories, 
  2.35  the portion that should have accrued to the township must be 
  2.36  administered by the county board of commissioners. 
  3.1      Sec. 4.  [EFFECTIVE DATE; LOCAL APPROVAL.] 
  3.2      Section 3 is effective the day after the governing body of 
  3.3   St. Louis county and its chief clerical officer timely complete 
  3.4   their compliance with Minnesota Statutes, section 645.021, 
  3.5   subdivisions 2 and 3.
