A bill for an act
relating to human services; modifying the construction project rate for certain
nursing facilities; amending Minnesota Statutes 2016, section 256B.434, by adding
a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 256B.434, is amended by adding a subdivision
to read:

Subd. 4j.

Construction project rate increase for certain nursing facilities.

(a) This
subdivision applies to nursing facilities:

(1) located in Ramsey County;

(2) with at least 130 active beds as of September 30, 2017;

(3) with a portion of beds dually certified for Medicare and Medicaid and a portion of
beds certified for Medicaid only; and

(4) with debt service payments that are not being covered by the existing property
payment rate on September 30, 2017.

(b) The commissioner shall increase the property rate of each facility meeting the
qualifications of this subdivision by $7.55.

(c) Notwithstanding any other law to the contrary, money available under section
144A.073, subdivision 15, after the completion of the 2018 moratorium exception approval
process under section 144A.073, subdivision 3, shall be used to pay the medical assistance
cost for the property rate increase in this subdivision.

EFFECTIVE DATE.

This section is effective January 1, 2019.
