  1.2             relating to human services; eliminating the enrollment 
  1.3             limitation for the prescription drug program; amending 
  1.4             Minnesota Statutes 2000, section 256.955, subdivision 
  1.5             9. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 256.955, 
  1.8   subdivision 9, is amended to read: 
  1.9      Subd. 9.  [PROGRAM LIMITATION REBATE REVENUES.] The 
  1.10  commissioner shall administer the prescription drug program so 
  1.11  that the costs total no more than funds appropriated plus the 
  1.12  drug rebate proceeds.  Prescription drug program rebate revenues 
  1.13  are appropriated to the commissioner and shall be expended to 
  1.14  augment funding of the prescription drug program.  New 
  1.15  enrollment shall cease if the commissioner determines that, 
  1.16  given current enrollment, costs of the program will exceed 
  1.17  appropriated funds and rebate proceeds.
