A bill for an act
relating to health; allowing the Department of Health to collect information on
firearm ownership under certain circumstances; amending Minnesota Statutes
2016, sections 13.3805, by adding a subdivision; 144.05, subdivision 5.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 13.3805, is amended by adding a subdivision
to read:

new text begin All data created, collected, received, or maintained by
the Department of Health on individuals with firearm ownership is private data on individuals
and must be de-identified for purposes of public health research or epidemiologic
investigation. Health data on individuals with firearm ownership under this section may not
be disclosed to any person or agency unless it is de-identified. For purposes of this
subdivision, "de-identified" means the process used to prevent a person's identity from being
connected with information and ensuring that all personally identifiable information has
been removed.

Sec. 2.

Minnesota Statutes 2016, section 144.05, subdivision 5, is amended to read:


Subd. 5.

Firearms data.

Notwithstanding any law to the contrary, the commissioner of
health is prohibited from collecting data on individuals regarding lawful firearm ownership
in the state or data related to an individual's right to carry a weapon under section 624.714new text begin ,
except for the purpose of public health research or epidemiologic investigation. The
provisions of section 13.3805, subdivision 6, apply for collection of data on individual
firearm ownership for public health research or epidemiologic investigation
