A bill for an act
relating to higher education; permitting reclassification of leave of absence.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin LEAVE OF ABSENCE RECLASSIFICATION.

new text begin (a) Notwithstanding Minnesota Statutes, section 136F.43, subdivision 2, the Board of
Trustees of the Minnesota State Colleges and Universities may reclassify a leave of absence
taken under Minnesota Statutes, section 136F.43, subdivision 6, between July 1, 2006, and
June 30, 2008, as part of an extended leave of absence taken between August 1, 2010, and
September 1, 2013, if:

new text begin (1) the total days of the combined leave does not exceed five years;

new text begin (2) the teacher worked with a federal agency during at least one of the leave periods;
and

new text begin (3) the board and the teacher negotiate the contributions required under Minnesota
Statutes, section 354.094.

new text begin (b) Notwithstanding any law to the contrary, a leave of absence reclassified under this
section is an extended leave of absence taken under Minnesota Statutes, section 136F.43.
