  1.1                          A bill for an act 
  1.2             relating to education finance; authorizing a pilot 
  1.3             program to allow school districts to spend 
  1.4             compensatory revenue at school sites with low test 
  1.5             scores; amending Minnesota Statutes 2002, section 
  1.6             126C.15, subdivisions 2, 3. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 126C.15, 
  1.9   subdivision 2, is amended to read: 
  1.10     Subd. 2.  [BUILDING ALLOCATION.] (a) A district must 
  1.11  allocate its compensatory revenue to each school building in the 
  1.12  district where the children who have generated the revenue are 
  1.13  served unless the school district has received permission under 
  1.14  section 3 to allocate compensatory revenue according to test 
  1.15  score results. 
  1.16     (b) Notwithstanding paragraph (a), a district may allocate 
  1.17  up to five percent of the amount of compensatory revenue that 
  1.18  the district received during the previous fiscal year to school 
  1.19  sites according to a plan adopted by the school board. 
  1.20     (c) For the purposes of this section and section 126C.05, 
  1.21  subdivision 3, "building" means education site as defined in 
  1.22  section 123B.04, subdivision 1. 
  1.23     (d) If the pupil is served at a site other than one owned 
  1.24  and operated by the district, the revenue shall be paid to the 
  1.25  district and used for services for pupils who generate the 
  1.26  revenue.  
  2.1      [EFFECTIVE DATE.] This section is effective July 1, 2004, 
  2.2   for revenue for fiscal year 2005. 
  2.3      Sec. 2.  Minnesota Statutes 2002, section 126C.15, 
  2.4   subdivision 3, is amended to read: 
  2.5      Subd. 3.  [RECOMMENDATION.] A school site decision-making 
  2.6   team, as defined in section 123B.04, subdivision 2, paragraph 
  2.7   (a), or the instruction and curriculum advisory committee under 
  2.8   section 120B.11, if the school has no school site decision team, 
  2.9   shall recommend how the compensatory education revenue will be 
  2.10  used to carry out the purpose of this section.  A school 
  2.11  district that has received permission under section 3 to 
  2.12  allocate compensatory revenue according to test results shall 
  2.13  share its plan for the distribution of compensatory revenue with 
  2.14  the school site decision team. 
  2.15     [EFFECTIVE DATE.] This section is effective July 1, 2004, 
  2.16  for revenue for fiscal year 2005. 
  2.17     Sec. 3.  [COMPENSATORY REVENUE ALLOCATION; TEST SCORE PILOT 
  2.18  PROGRAM.] 
  2.19     Subdivision 1.  [PILOT PROGRAM CREATED.] A three-year pilot 
  2.20  program is created to allow a school district to allocate 
  2.21  compensatory revenue received under Minnesota Statutes, section 
  2.22  126C.10, subdivision 3, among its school buildings according to 
  2.23  each building's test scores. 
  2.24     Subd. 2.  [APPLICATION PROCESS.] A school district that 
  2.25  seeks to allocate its compensatory revenue to school sites based 
  2.26  on student performance may submit an application to the 
  2.27  commissioner of education by June 1, 2004.  The application must 
  2.28  include a written resolution approved by the school board that: 
  2.29  (1) identifies the test results that will be used to assess 
  2.30  student performance; (2) describes the method for distribution 
  2.31  of compensatory revenue to the school sites; and (3) summarizes 
  2.32  the evaluation procedure the district will use to determine if 
  2.33  the redistribution of compensatory revenue improves overall 
  2.34  student performance.  The application must be submitted in the 
  2.35  form and manner specified by the commissioner. 
  2.36     Subd. 3.  [COMMISSIONER SELECTION.] The commissioner may 
  3.1   select up to five school districts to participate in the pilot 
  3.2   program.  The commissioner must notify the selected school 
  3.3   districts by July 1, 2004. 
  3.4      Subd. 4.  [REPORT.] The commissioner of education must 
  3.5   submit a report by February 15, 2007, to the education 
  3.6   committees of the legislature evaluating the effectiveness of 
  3.7   the pilot program. 
  3.8      [EFFECTIVE DATE.] This section is effective the day 
  3.9   following final enactment.
