  1.1                          A bill for an act 
  1.2             relating to health; authorizing the dispensing of a 
  1.3             prescription written by a physician, osteopath, 
  1.4             podiatrist, dentist, or veterinarian licensed in any 
  1.5             state or jurisdiction of the United States; amending 
  1.6             Minnesota Statutes 1994, section 152.11, by adding 
  1.7             subdivisions. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1994, section 152.11, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 4.  Notwithstanding subdivisions 1 and 2, a person 
  1.12  may dispense a controlled substance included in schedule II, 
  1.13  III, or IV of section 152.02 with a prescription written by a 
  1.14  doctor of medicine, a doctor of osteopathy licensed to practice 
  1.15  medicine, a doctor of dental surgery, a doctor of dental 
  1.16  medicine, a doctor of podiatry, or a doctor of veterinary 
  1.17  medicine lawfully licensed to prescribe in any state or 
  1.18  jurisdiction of the United States if the prescription is 
  1.19  dispensed: 
  1.20     (1) by a pharmacy located in Minnesota and is delivered by 
  1.21  mail or other courier; or 
  1.22     (2) for a person who is not a resident of Minnesota but who 
  1.23  is physically present in Minnesota at the time the prescription 
  1.24  is dispensed. 
  1.25     Sec. 2.  Minnesota Statutes 1994, section 152.11, is 
  1.26  amended by adding a subdivision to read: 
  2.1      Subd. 5.  Nothing in this section may be construed to 
  2.2   authorize a person licensed in another state or jurisdiction to 
  2.3   prescribe a controlled substance with intent to assist another 
  2.4   in taking the other's own life in violation of section 609.215 
  2.5   with intent or knowledge that the prescription will be dispensed 
  2.6   in Minnesota.
