  1.1                          A bill for an act
  1.2             relating to highway traffic regulations; prohibiting 
  1.3             the transport of animals in motor vehicles unless 
  1.4             protected or secured; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 169. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [169.431] [TRANSPORTATION OF ANIMALS IN MOTOR 
  1.8   VEHICLES.] 
  1.9      Subdivision 1.  [RESTRICTIONS.] A person shall not 
  1.10  transport an animal in the back of a motor vehicle in a space 
  1.11  intended for a load on the vehicle on a public roadway unless 
  1.12  (1) the space is enclosed, (2) the space has side and tail racks 
  1.13  to a height of at least 46 inches extending vertically from the 
  1.14  floor, (3) the animal is cross tethered to the vehicle, (4) the 
  1.15  animal is protected by a secured container or cage, or (5) the 
  1.16  animal is otherwise protected in a manner that prevents the 
  1.17  animal from falling, jumping, or being thrown from the vehicle. 
  1.18     Subd. 2.  [EXCEPTIONS.] Notwithstanding subdivision 1, this 
  1.19  section does not apply to: 
  1.20     (1) a dog being transported by a farmer or farm employee 
  1.21  who is engaged in agricultural activities requiring the services 
  1.22  of a dog; or 
  1.23     (2) a hunting dog at a hunting site or being transported 
  1.24  between hunting sites by a licensed hunter who is in possession 
  1.25  of all applicable licenses and permits for the species being 
  2.1   pursued during the legal season for that activity.
