  1.1                          A bill for an act 
  1.2             relating to the environment; providing for legislative 
  1.3             review of aboveground storage tank rules; amending 
  1.4             Minnesota Statutes 1996, section 116.49, by adding a 
  1.5             subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 116.49, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3.  [ABOVEGROUND STORAGE TANK RULES.] After the 
  1.10  effective date of this section, any new rules or amendments to 
  1.11  existing rules that are proposed by the agency with respect to 
  1.12  aboveground storage tanks must be submitted to the legislative 
  1.13  committees with jurisdiction over the environment within one 
  1.14  week of publishing the notice of intent to adopt rules in the 
  1.15  State Register.  The rules may become effective no earlier than 
  1.16  90 days or the March 15 following the submittal, whichever is 
  1.17  later, except that if the submittal occurs between the date of 
  1.18  adjournment of the legislature and the following February 1, and 
  1.19  the rules are adopted following a public hearing, the rules may 
  1.20  become effective no earlier than March 15 of the year following 
  1.21  February 1. 
  1.22     Sec. 2.  [REPORT.] 
  1.23     No later than July 1, 1998, the pollution control agency 
  1.24  shall submit a report to the legislative committees with 
  1.25  jurisdiction over the environment which identifies all petroleum 
  2.1   facilities in the state with greater than 1,000,000 gallons 
  2.2   total capacity, the status of any permit applications at such 
  2.3   facilities, and any known pollution or contamination problems 
  2.4   and related cleanup plans or cleanup efforts at such facilities. 
  2.5      Sec. 3.  [EFFECTIVE DATE.] 
  2.6      Sections 1 and 2 are effective the day following final 
  2.7   enactment.
